 Hit a fence with my car, I have about $2,000 in damage, if I file a claim ($500 deductible) will insurance go?

How could it have been terminated without your knowledge? Either you pay the bill on time, or you don't. If you didn't pay the bill on time, there is no grace period, and no warning. They don't hold your hand. You're presumed to be capable of handling the payment on time, yourself.

Did you not pay your premium? If your premium is late, your COBRA can be cancelled...they don't have to accept a late payment from you.

Did you run out of time on COBRA? Its not indefinite - once you hit the end of your alloted time, you're cancelled.

You'll need to find out *why* you were cancelled first, then go from there to see if you have legitimate grounds for a complaint or not.

A couple of things could have happend.

1. You exhausted your 18 months of continuation as defined by federal law. (Or longer with some special situations and states such as California with Sup CAL-Cobra)

2. Have not satisfied your cobra paymen requirement.

3. Your employer dissolved or is no longer offering coverage to the rest of its employees.

Otherwise, if none of the above apply, you will need to reach out to your HR department for an explaination. If their explaination does not reference any of the above topics I would suggest calling the Department of Labor.

Contrary to popular beleif, Department of Insurance does not monitor Federal Cobra as this is a function of the federal gov't and specifically, an employer responsibility to report such to the carrier.

Did you run out of time on it? It doesn't go on forever. Did you miss a payment, or pay late? Did you contact your former employer and ask why it was terminated?

First: depending on the reason for the termination of your Group Coverage, you either had 18 months or 36 months of continuation available to you. Did time just run out? No notification is required by law when COBRA runs out (although it is typically provided). You should also have received a HIPAA Certificate of Creditable Coverage from your insurance carrier.

Second: did you pay on time? There is actually a 30 day grace period built into the law. If you do not pay by the first of the month, your coverage is "suspended" and eventually terminated if full payment is not received by the end of the 30 day grace period. If you didn't pay on time, or within the grace period, you have no recourse. If you think you did pay and were canceled in error, get your documentation ready.

Lastly: it could be an error. COBRA Administration is big business these days, but it is not without its share of errors. Big data files are shuffled back and forth and often times bits and bytes fall off, to some poor individual's great (but usually temporary) dismay.

All of the above should be resolved quickly enough with a call to your COBRA Administrator, whether that's in-house at your employer or a separate outfit like SHPS, Benefit One or Altus.

If you think your a victim of any misconduct the Dept of Labor is the right authority to contact, but you'd better have your case in good order *before* contacting them for assistance. They can bring down the Big Hammer, but they won't even lift it if they don't think there's proof or cause to do so.

They must leave you covered 18 months if you pay the bill on time. Check your canceled checks to make sure they were on time.

Contact the individuals who do the cobra for you! they are the only ones who are resp for the policy being termed and the policy being active!

My former employer switched third party administrators to tri-cor they never forwarded the premium to Kaiser Permanente, who terminated me. I get two stories from tri-cor. One rep told me that Kaiser has all the paperwork. I got Kaiser to call them, and another rep told Kaiser they never sent the paperwork. Tri-Cor's website indicates I timely paid 3 months of premiums. I'm going to contact my former employer and tell them it had better be resolved, to my satisfaction, with an appropriate paper trail, or I'm contacting the Dept of Labor's EBSA at rhe regional office. http://www.dol.gov/ebsa/aboutebsa/org_chart.html#section13

My husband was laid off and went on cobra. We were supposed to be covered for 18 months which would have been up 10-01-2011. We have not been late or missed a payment. We simply recieved a letter saying our coverage was terminated 3-01-2010. My husband called his former place of employment. We knew that the company had been sold several months ago but he was told when he called that the new owners had recently changed carriers and that they didn't realize that they had anyone on cobra, which is hard to believe. Several people were laid off before and after my husband. The company won't do anything for us and neither will Cobra. Help! I will tke the advice about the Department of Labor. Thanks

We had the same problem. The premiums were always paid on time. There are canceled checks to prove it. His former company wasn't dissolved. It was all due to a clerical error on the part of SHPS, and they admitted to it. My husband had sustained 2 broken arms in a bicycle accident and went through treatment and physical therapy. He presumed that things were being handled through the insurance (Blue Cross/BCBS) and all was seemingly well. But, SHPS screwed up and dropped him for alleged nonpayment. My husband only found out when some medical bills came back unpaid or after being sent to collections. SHPS is the administrator for his BCBS COBRA insurance. Even after SHPS admitted to the error, these bills still haven't been paid. They keep passing the buck back to BCBS, and BCBS keeps passing back to SHPS, The doctors still haven't been paid. Meanwhile, SHPS sent my husband notice that his premium was being doubled! Hubby has been fighting for payment for 6 months now. He keeps getting bills that say that things finally got paid, then a week later, another bill saying that the full balance is still outstanding. He wants to dump SHPS/BCBS and get his own insurance, but he was told that if he did, SHPS would decline to pay what is still due. Now the bills are going to collections! My husband is NOT a deadbeat. He pays his bills when they come due. He paid his copays and all up-front fees, premiums, etc. but now there's all this buck-passing and misinformation, and he has NO idea how much he really owes, as he hears a different amount every single time he calls a provider or gets a statement. First, it says that he's paid up, then he gets another bill saying that hte bill was kicked back, then another saying he owes a partial payment amount, then another saying that he owes nothing-- then the collection notices for the full amount... and he is tired of all of this. He wants out, but was told that if he drops/changes coverage or doesn't pay the doubled premium, then SHPS won't pay the claims. What can we do?
