What can I do when GEICO insurance don't pay me what I think is fear?
My wife had an accident last week. It wasn't her fault as the police saw. They can't fix the car because is more expensive than give us its actual value. Geico has offered us $3306 but we think that's not a fair price. Geico said can't give us any more money. What kind of help or where should we ask for?

The car is a '01 Saturn SL1, manual, Miles: 139000. We didn't have ANY problem with it; it's without a doubt the best car I had in my life.

Well, they finally offered us $ 3500. After all I read in your answers and I checked in others websites I think isn't make any sense look for a Lawyer because they aren't going to give us so much more. We really want this done ASAP. Ok guys, THANKS FOR ALL YOUR ANSWERS!!

The insurance company does not use the Kelly Blue Book. Do not waste your time checking that value.

The insurance companies and banks use the NADA (National Automobile Dealers Assoc) book. Using the limited information you provided, I checked the value there and Geico seems to be about right.

What do you value the car at?
What data is your value based on?

The car is not worth more just because you say so or because you want more.

But -- again, from the very very limited information in your answer-- Geico's offer seems fair.

Geico owes you the Actual Cash Value of your car. What someone would have purchased the car for. You may want ask $27,000 for the car b/c it's worth that much to you. Does not mean someone would pay that for it. The car's ACV is what someone would have actually been willing to pay for the car to purchase it just prior to the accident- given its age, condition, options and mileage.

If you don't like their offer- file under your collision coverage and see what kind of offer your insurance company makes. No guarantee it will be higher - but you can see what they come up with. Then they will subrogate back against Geico for repayment.

As stated, they owe you the actual cash value of the vehicle. Their offer sounds about right for the average condition vehicle you described. If you have maintained this vehicle in top condition, you might be able to get more. But you are going to need maintenance records to prove it.

You can also look for sales in your local market to see whether that value is correct. NADA generally gets the values close, but on occasion they miss it. I doubt it for a Saturn.

Overall, it is now up to you to prove that your vehicle is worth more than what was offered. You can file a complaint with the DOI. You can sue. And in both cases you will have to show that their value is not fair.

OK, I am on my second Saturn, and I LOVE it. I loved the first, too.

Well, you are your own agent - that's a problem, with Geico - no one to battle for you.

Police don't determine fault, though. If it wasn't her fault, that means it's someone else's fault, right? In which case, if they have insurance, you can go through their insurance.

On the car. You have a deductible - how much is it?? I took a quick pop over to www.kbb.com to get a guestimate of value, assuming decent body, it's going to be about $3100, less your deductible.

So *I*, a major Saturn fan, think it's a fair offer.

Understanding about depreciation of a car, and insurance is important if you want to lessen the headaches. Have you gone to Edmunds.com to find out what the value of the car is? And then, you need to calculate the depreciation and the wreckage. That's what adjusters do. And how do you know that what they are offering is not a fair price? You just totalled it. Hey. In Australia we have a consumer ombudsman. I'm sure you have one too. The role of the consumer ombudsman is to investigate complaints against companies to ensure you are being treated fairly. If the Kelly Blue Book has a similar price then you probably won't get any more money. But you could always send a letter of complaint to Geico first.
