We live in southeast Louisiana. After Katrina none of the insurance companies are writing new policies and they're trying very hard to get rid of all the existing policies and effectively make the region uninsurable and thus unlivable. The Insurance Commissioner stepped in 2 years ago and told the companies that they cannot drop per se their policies. So now they're trying every which way to remove all their clients by raising the appraisals to obscene and unrealistic levels.
We recently got reappraised and the appraisal was like I said before, completely out the roof. We fought them and they finally brought it down to at least a realistic number. The only thing is now they're trying to tell us that if we don't remove our trampoline they'll drop our coverage. All the companies in the region are supposedly doing this and it is literally impossible to get a new plan now.
Can a company force us to do that; remove our trampoline? I think this is extortion and I'd like to sue them. What's the point of having insurance if they won't cover anything? The point of an insurance company is to help people get out of unfortunate disasters and accidents, NOT make a profit for their shareholders. |

First of all, there isn't an insurance company in the whole USA that will write a homeowners policy on a house with a trampoline, knowingly, to the best of my knowledge. Trampolines are an EXTREME liability hazard. They are responsible for more payouts than Pitt Bull bites. Or at least, HIGHER payouts than ANY dog bites.
So. Yes, they can. That trampoline is an "increase in hazard". A SERIOUS increase in hazard.
The point of having insurance, is to protect against UNFORSEEABLE accidents. A trampoline is NOT an unforseeable accident - it's a major liability claim just waiting to happen. Even if you have it enclosed. Kind of like, a swimming pool with no fence, next to a daycare. Or breeding pitt bulls for illegal dogfights.
The insurance contract is a two way street. They can't "make" you do something you don't want to - but if you don't, you can't "make" them keep insuring you. And again, WITH a trampoline, I don't know of ANY company that will give you homeowners, even if you were NOT in LA. This isn't a Louisana issue. This is a trampoline issue. |

Where on earth did you get the idea that insurance companies are 'not there to make a profit, but to help people get out of unfortunate disasters and accidents ? Are you living on some other planet ?
The losses incurred during the Katrina disaster nearly took some insurers to the brink of bankruptcy. They need to recover that lost money somehow. Yes, they have raised premiums on the REST of us who do not live anywhere near the Katrina disaster as well.
Meanwhile, your situation with the trampoline exists EVERYWHERE, and not just where you live. Trampolines are an open invitation to injury liability lawsuits. If you want coverage, get rid of the blasted thing. They ARE dangerous. |

Wrong! If an insurance co does not make a profit, why bother to be in that business. They are not charities, you know.Then who provides insurance, the government? Lots of luck!
As far as the trampoline is concerned, imagine, a neighbor's child gets in there , bounces around, falls off an injures his back. Bingo! A 6 figure lawsuit against you !!! So, you remove it or they cancel the policy. |

I'm not sure but I think they can. The government can't force a company to insure someone which is why I think in California anyhow the earthquake insurance is through the state. I have heard of people being told they had to change one thing or another or be dropped from the insurance using the "making an unsafe environment" excuse which sounds like the insurance company your dealing with is trying to use. Instead of flat out telling you it's because of the flooding problem of the region they are trying to find something they normally don't pay much attention to to drop you. It's unfortunate that is what insurance has come to these days. All insurance companies have gone into the "profit" business but at the same time they have to ensure based on projects that they have enough to pay out those policies. The region you live in happens to be hammered a lot the past few years. I can only think what is going to happen when another large earthquake happens here in California. Definitely if you feel you have a claim you can talk to a lawyer. You might be able to get free counseling through your employer if it's part of your benefit package which costs you nothing. Anytime I have a question about something I contact my lawyer to get an explanation. |

don't fool yourself. Insurance companies are ONLY about making a profit for their shareholders. Any time it comes to give money back to their actual customers, they will fight tooth and nail against it. As far as your trampoline goes...I imagine they can do whatever they want. They could categorize it as an unnecessary risk and choose not to insure you. Doesn't seem right, but it wouldn't surprise me. I'm in Michigan and though I don't know if they can deny you coverage, a trampoline on your property will definitely increase your rates. |

there is an insurance commissioner in your state that you can report them to. google insurance commissioner,and consumer rights-you should be able to find links to resources for assistance/advice.
you also might want to hire a good attorney and start a class action lawsuit |
