Why don't you just file a claim with your homeowners insurance? Most homeowners policies cover vehicles as a named peril. You would be out your deductible, but it would be worth it not to have deal with small claims court. This would ensure the wall would get repaired correctly, and you wouldn't have the hassle. Then, just let your insurance company go after the uninsured person. If they happen to recover all the money, they would refund your deductible to you. It's unlikely...but possible.
But trust me, you would spend more on attorney fees going after this guy than what your deductible would be. It would definitely be worth your while.
PLUS** Just because you get a judgement against the guy in court doesn't mean he'll have the money to pay you. Chances are, if he doesn't have enough money to pay for insurance, he won't have the money to satisfy the judgement. Go through you insurance company! |

Ouch...that really sucks. Well, any car accident is a royal pain in the a** as it is...
First off let me ask, did you file a police report? If it's documented the person can lie all they want...it's what's in writing that counts!!
Secondly, if they don't have insurance, then to get your money you will have to sue them. Consult an attorney that specializes in accidents/small claims and they can put together the paperwork for a reasonable price. Once the person responsible receives the summons, they will have to show up to court. If they don't show up the first or second time, I believe you automatically win the case and you can get collections after them.
Believe me when I say it's a real pain and tedious, but hey, you gotta do what you gotta do. The professionals will steer you in the correct direction. Good luck!! |

I had something very similar happen. Eventually, I did get the money from the person (after a lot of legal hassle), but I was able to get the repairs done through my insurance without paying any deductibles because I was able to prove that the person was responsible/at-fault for causing the damage. If you didn't file a police report, you should do so...that way, if you have to go the legal way, it will expedite the process. Make sure that you take pictures of the damage, and take several pictures during the repair process as well. Detailed documentation is the best way to guarantee you will get reimbursed one way or another. |
