What could I do if a company keep sending billing statements that were not my responsibility?
I have done an x-ray in a lab a year ago. The lab failed to submit the claim to the insurance company soon enough. As a result, the insurance company refused to pay the claim. Then, the lab sent the bill to me and also letters that threatening me that my accould would be placed with a collection agency. At one point, the lab admitted that this was between the lab and insurance company and not my responsibility. However, I still receive the statements which are extremely annoying and could potentially damage my credit score if it goes to the collection agency. What could I do? Can I sue the lab for being harrassing me with the statements and letters?

Just saw your post and hope I'm in time to help: First of all,
in the managed care arena, (where we all have to live now)
this is called "untimely filing" and as long as you provided the correct insurance info to the lab at the time of service, you ARE NOT RESPONSIBLE FOR THIS BILL. PERIOD.
The lab has a responsibility as a contracted preferred provider to file within a timely fashion, typically anywhere from 90 days to one year. Their failure to do this means THEY must write off the bill. If they try to harass you or hurt your credit, call your insurance company and report them.
They cannot have it both ways.

Since the lab failed to file the claim in the appropriate time frame, they should take some liability for this. However, it ultimately fall on you and your credit record. Call the lab and ask to speak to the billing supervisor. Explain to them that the lab failed to file the claim on time and that you do not want to be held responsible. Best case, they'll agree and take it off, worst case they'll say no. They might even agree to split the cost with you. That's probably the best you can do.

Do you still have the same insurance company? If so, then they are still liable for the bill. If not they still are liable for the bill and I would go as far as I could go in that company to get them to pay the bill.

I would then contact the medical lab and let them know what you are trying to do. Get the names and dates of who you speak with and keep a diary.

The lab will eventually sell your debt to a collection agency and you "ain't" seen nuttin yet. Keep after it and you will finally get it taken care of but putting your head in the sand won't help.

Pay the bill. You are responsible. I would then attempt to reason with the insurance company.

Pay the bill to keep it from affecting your valuable credit rating. Then, make an appeal to the insurance company regarding their decision to deny it.

They would have paid if the bill had been sent in sooner? By personal experience, I believe the insurance company can still be made to pay, as long as you were insured at the time of the medical proceedure.

If it was two or three years after your medical proceedure that the lab waited to bill your insurance, they should just write it off, due to the fact that they were not doing their jobs in sending out claims statements to the insurance co. If this is the case, I'm sure they will at least negotiate a smaller payment.


If you can't get any satisfaction, write a letter to your state insurance complaints dept., and send a copy of it to your insurance company's claims dept. by certified mail.

You should have a positive answer within 30 days.

That bill is your responsibility to pay. If your insurance company refuses to pay you are going to have to pay it

Well, the problem is, it IS your responsibility. Ultimately, any medical procedures you have done, YOU will be required to pay for, if the insurance denies it.

They will take this through collections, and eventually garnish your wages, until this gets straightened out.

Good luck, on getting something in writing from the lab, stating it's between them and your insurance.

The lab provided the service, and they're billing you for it. You can't sue them for billing you, they can sue you for not paying. And they will, eventually.

Well with the insurance company I work for, if the providers are PPO and the provider didn't submit the claim in a timely matter it's denied and it's the provider's responsibility. The same if a claim is denied as not medically necessary, it's the PPO providers liability. I would have the insurance company investigate if there are any stipulations in their contract regarding filing limits and such. Sometimes their contracts allow beyond the standard 1-2 year filing limits.

Check your explanation of benefits. What denial reason did they use..is there anything under the patient liability column? If the explanation of benefits show you are not liable than I would call your insurance company and have them do a three way call with the provider while they explain that you're not liable.
