Best of my knowledge, I am required to have liability auto coverage.
I do and I also have pip.
Another driver pulls in front of me, causing accident,,police report and witnesses agree on this.
I am getting treatments 3 times weekly for whiplash.
Now my first question is why does Texas require liability when my pip- is paying the med bills?
Now my second(is this legal?) the adjuster for auto says about half what the shops say and I want to do the work myself.
I want the higher amount and it is a parts price difference. |

So the other person was found to be at fault then.
Liability is required to pay for damages to the other party. For example: You rear-end my car, and are found at fault. YOUR liability coverages (Bodily Injury and Property Damage) will pay for the damages to ME (my car and my body). PIP is a secondary, non-mandatory coverage, and typically pays out faster than BI.
As far as the adjuster goes, they have to indemnify you. Which means, they have to return you to the state you previously enjoyed before this incident occurred. Why didn't you just file the claim with your company using your collision coverage and have your company go after the other insurance company (called subrogation)? Unless you just have liability and PIP.
I live in the Lone Star state as well, and I highly recommend getting Uninsured/Underinsured Motorist coverage as well. It's rumored that 25% of drivers stopped are driving without insurance. |

Liability is for damage you to do other people. Look at that pip limit - That $10,000 doesn't go very far, when it comes to real injuries. Also, in TX, your auto carrier is going to go after that guy, for however much they pay out on your behalf, for the pip. His liability should pay that.
Most policies in TX allow for the insurance company to use USED parts to repair your car. So if the parts price is new vs used, or original manufacturer vs after market, you have to pay the difference yourself.
Additionally, unless you're licensed for bodywork, the insurance company will require you to prove that the damage was 100% repaired - with photos and a certification from a real shop, which you'll have to pay for, or else they'll delete the collision and comprehensive from your policy. AND, you will still only get paid the negotiated labor rate, which in most cases, is around $25 an hour. |
