What happens if you answer "no" to the question "Have you used nicotine in the past year"?
On a life insurance policy application but you really do. What would happen if you started smoking after it was in effect? Would the company not pay the beneficiary when you died? How would they know?

Generally, you will have to submit to a blood test or a saliva swab with most life insurance applications. That is when they'll find out. They may also find out if they request doctor records.

Most life policies have a two year contestability period, so if they find out within those two years they'll rescind the policy.

I asked this question to my insurance agent once and have seen this in the FAQ with my group life insurance at work. Perhaps an insurance agent can answer your question better, but I'll tell you what I know.

I was told that upon your death, the insurance company will request a blood test be done. The blood will be tested for the presence of nicotine and its byproducts (I'm guessing amongst other things).

If you test positive and you are not on a smoking policy of some sort (some carriers have a preferred smokers policy for occasional smokers), the full amount of the policy will not be paid. I have never heard a number of how much it will be reduced, just that the full amount will not be paid.

According to my insurance agent, nicotine stays in your system for about 1 year (which I found questionable, but I am not initimately familiar with the chemical breakdown process in the human body as it relates to nicotine).

Personally, I just pay the higher premiums, even though I only smoke a few packs a year.

I would be as honest as possible. If they found out you lied, they could probably fight it in court and not pay if something happened to you.

While the folks answering above are well-intentioned, it is inaccurate to state the insurer will definately rescind the policy if you die within the first two years. In fact, not all states permit the rescission of a life insurance contract when an insured misrepresents a history of smoking. States that prohibit this practice only permit insurers to rescind if the misrepresented medical condition caused or contributed to the death. So if a person lied and said he wasn't a smoker, then died because a bus hit him, the insurer CANNOT rescind if the contract was issued in one of those states.

But what does it really matter whether your state is one of these? It's always best to tell the truth: that's the only way you can be sure this policy will be there to help your family when they need it the most.

If the policy is in the contestable phase, they'll pull all your old medical records, to see if you've ever smoked (the question doesn't say "today" it says, in the past 5 years, or whatever.)

If you lie, they'll find it. They'll ALSO find it when they do the blood/saliva check, even before they issue the policy. But, if they don't do that blood/saliva check, and the polciy is contestable, and you lied, then they don't pay out.

If you make a factual misrepresentation to the insurance company, your policy could be null and void if you die during the contestability period.

If you are in the process of quitting, it is much better to pay a slightly higher rate until you can re-write the coverage at non-tobacco rates.

If you use snuff, cigars, nicotine patch, etc, anything that isn't a cigarette, you should find a company that would offer you non-smoker rates anyway. Some may allow non-smoker rates even if you test positive for nicotine, as long as you are truthful on the application.

What slider 72 said...but be honest. It's worth it to know that your benefit will be paid just as you intended, as opposed to worrying about it at night.
