12 year old girl is near death and had to go to the hospital. Family has little money. (Father makes 9 dollars and hour). Mother stays home. Does the hospital say to father "Sorry. She must die because you are poor". Then they trow the family out to allow the girl to die?

You get bills for the services.
If this is a life threatening issue, then the hospital is required to treat her. But they are NOT required to waive costs - so the family will get a bill.
If it's NOT immediately life threatening - ie, she has cancer - then they are NOT required to pay for her ongoing chemotherapy.
However, the parents are being irresponsible here. Clearly, dad can't support a family on $9 an hour. Dad either needs to get a better job, a second job, and/or mom needs to go to work. Also, every state has a childrens health insurance program for low income families, and their children. If mom and dad haven't applied for that (which would be free health insurance with that kind of income, for the kids), they are being irresponsible. |

~~I don't know if this is true in all states, but in California we have county hospitals which will take people without insurance. You can usually negotiate prices to income. I fervently hope that this is the cse for all states.~~ |

most hospitals have to take a person and not worry about there ability to pay, especially if the person is pregnant or risks life or limb. i couldn't imagine waiting so long as having a child near deaths door before i sought help. |

They are required to treat to try to save life. Aside from that, extras like cosmetic repair will not be done.
The family (parents) should apply for financial aid from the county or state as that's poverty level and they will prolly qualify. Most counties offer poor families the opportunity to apply (even before need) for indigent care and have their essential medical care subsidized by county or state hospital system. |

Under EMTALA, participating hospitals (any hospital that accepts payment from the federal government such as Medicare or Medicaid) must treat anyone coming to the ER
From http://www.emtala.com/faq.htm:
Any patient who "comes to the emergency department" requesting "examination or treatment for a medical condition" must be provided with "an appropriate medical screening examination" to determine if he is suffering from an "emergency medical condition". If he is, then the hospital is obligated to either provide him with treatment until he is stable or to transfer him to another hospital in conformance with the statute's directives. |

They have to treat your ailment first. |

At the hospitals where I live, they cannot refuse to treat you just because you don't have the money to pay. They have to give you the best treatment and care and offer any tests available that they would anyone else |
