Why was there no beneficiary. Insurance companies will not issue a policy without a beneficiary. If the beneficiary is no longer living it will go to the estate of the beneficiary and to their heirs or to a contingent beneficiary. It will not go to the spouse except through probate.

well maybe you can fight to get a piece of it. no beneficiaries well dude should have had someone fixing his final burial in the insurance policy unless they think of it.

There is always a beneficiary. If all beneficiaries are deceased prior to insured dying, it will go into insured's estate.

If beneficiary dies after insured dies, it goes into beneficiaries estate.

Well, the "married" part has very little to do with it, sorry.

When the policy was first issued, there WAS a beneficiary assigned. You can't REVOKE a beneficiary leaving NO beneficiary, but you CAN make the beneficiary "your estate".

So, the insurance company will either pay the estate of the deceased - where the insurance will be used to pay any debts before being distributed to the heirs in accordance to a will or probate judge, or to the listed beneficiary, or to the estate of the beneficiary if the original beneficiary is deceased.

The wife doesn't "automatically" get any procedes from a life insurance policy, sorry. Although they are PROBABLY entitled to procedes from the estate - but if there's no will saying otherwise, a JUDGE will distribute the procedes.

It will go into probate court. Probate court will take a cut and then divide the insurance money with Oklahoma law. The usual split is either 100% to the surviving spouse, or 50% to the surviving spouse and 50% divided among the surviving legal children. If you are divorced from the deceased, you have no claim on any part of the money. This is why it is so important to have a will. Probate will take a percentage of that money for distributing it to the proper parties.
