What happens when there is a loan on a house and no death insurance, and the house is being left to me?
My Mom was recently diagnosed with lung cancer. She is wanting to revise her will due to changes with in the family. She wants to leave me her house. There is a loan on the house that is "non-transferable" and there is no death insurance. Does anyone know how that would work? I feel so helpless not knowing answers for her!

suzeq1206, Home insurance covers lots of different things. I'm not familiar with all the fine print of my homeowners policy, but my home insurance agent is always helpful. Try contacting your agent or a agent in your city. http://www.americaschoicetoday.com/Home-Insurance.html They should be able to help you.

Sounds like she should sell the house. This might be hard to do in this market... but if the loan isn't transferable, I don't see other options. Sounds like she could only leave you the house if the loan was paid off. Until the loan is paid off, she doesn't really own the house- the bank does.
If the house is "under water" (meaning that the loan is for more than the house is currently worth) then the only thing to do is walk away! This sort of situation is what caused the current economic mess. People thought house prices would go up forever. They forgot that what goes up, sometimes goes down.

The house probably would need to be sold to pay off the loan, and THEN anything left over would go to you. Or, you'd have to refinance that loan, in order to get the title changed over.

You can't get the title to the house changed over, until that outstanding loan is paid off, one way, or another.

Buy out the loan. You would only be inheriting her equity in the house.

Think about just keep making the payments.

Have your mom set up a Living Trust that will put the home in the trust and then leave it to you or whoever she wants.

You might repost your question under real estate and under personal finances to get better answers there too.

Does she have credit insurance through the mortgage holder or bank that originated the loan? Though she has no life coverage, does she have any kind of mortgage coverage?

On the other side of the coin a diagnosis is not a death sentence, your mother may be in for a battle, but if she is up for the fight, she can win.
