What if someone never recieved a medical bill in the mail?

someone applied for medical insurance for they're newborn baby 2 years ago but they have never recieved a bill once. But now they recieved a bill askin for payment. The hospital went out of business and they got the insurance from a social worker in the hospital
and now 2 years from then theyre asking for collection

Is their anyway to avoid this
they dont think they have enough proof to take it to court
what should they do?

they want a large sum of money
and this person has to pay it in 4 months
they threatened to take the person to court

there is a limit to the amount of time a medical service provider has to submit claims for payment to the insurance company. Provided the patient has met their obligation (paid their co-pay) they should not have any further obligation to pay. Balance billing is illegal.

Collect all cancelled checks, invoices, statements from hospitals, etc. Get everything in writing and then go talk to a lawyer.

When a hospital goes out of business, collection agencies buy their debts, in the hopes that they can recupe enough money to warrant buying the debt. Since it was two years ago, just call the number on the bill and tell them that it was 2 years ago and you don't have any insurance information going back that far. They will write it off.

You only hope is to negotiate a reduced payment with them and pay it off. If you received the service, you owe the money. Unless you can find the insurance paperwork; then you are covered..

I think you are saying that a lady bought insurance that she hoped would cover all or part of the charges for having a baby.

Now two years after the baby was born the hospital is asking for money for the birth and the mother can not find any proof of insurance.

If that is what you are asking, and you are saying the hospital went out of business, then who is billing her for the money? I would contact whoever that is and give them all the information you have about the insurance company. If they become difficult then I would contact the State government medical board and get help from there.
