dustin g | What is the average settlement for a minor car accident? |
I was rear ended and have minor whiplash. What should I ask for my P&S cost (above my medical bills) |
|

There is not enough information to answer that question thoroughly. I would need to know duration of treatment, diagnosed injury, type of treatment, jurisdiction, pre-ex conditions, wage loss, etc.
I am assuming by minor you mean little treatment and whiplash of neck only. Say you had 1 or 2 doctors visits I would offer you $300-$750 above meds. Additional treatment would not get you much. I would say 1k at the absolute most and I do mean most. Jurisdiction and state laws play a big role. My experience comes from working Kansas and Missouri claims. Not worth getting a lawyer.
I would ask for 1k and settle for $500. |

dustin g,
There is no "average" amount. It will be based on your particular situation (medical bill amounts, type of treatment, amount of diagnostic work, severity of the crash, jurisdiction). In general, don't get your hopes up. You didn't hit the lottery. Soft tissue injuries just don't generate the kind of settlement that they used to. |

5,000 dollars...if you dont use a lawyer..just settle with the insurance company..they will try to low ball you at first its their job..just be firm..your meds should be paid buy your pip..good luck..later |

It really varies by jurisdiction, certain geographical areas tend to have very high jury awards, thus increasing the amount that an insurance company is willing to settle for, i.e.-new york and alaska. Generally though any soft tissue injury will generate $300-$2000 depending upon treatment, severity of complaints of pain, duration of treatment and so on. I wouldnt get a lawyer for this small of a settlement, these are easily handled by indivuduals with reasonable expectations. |

It is best to ask a lawyer taking it on commission. |

Your insurance company will determine that from your accident report and your body repair estimates.
If you're not sure, seek an injury attorney that doesn't charge you up front. |

Speaking for every insured driver, please do not file a suit for pain and suffering driving up our insurance rates... again!!!!
It actually does depend on a lot of things as far as your settlement. You may get a few hundred dollars as whiplash is painful, but it's not life threatening and is just a temporary uncomfortableness. In all honesty, you aren't going to get much sympathy for this as so many people claim it, and it's diminished the amount paid for pain and suffering. However, whiplash is a soft-tissue injury and is actually hard to prove. Only you know how much pain you've experienced, but you will probably be surprised that if they decide to pay anything, you may get a few hundred dollars. Unless the other driver was really negligent, I would probably recommend just sucking it up and not seeking any monetary damages for such an "injury." |

You have not told us enough for anyone to give you a value. What treatment did you have(was it just doctor visits, or chiro/physical therapy- did you have diagnostic testing, if so what did it show?) and for how long? Where did this happen? Did you have out of pocket medical expenses? How old are you, did you miss time from work- if so how much? Do you have any prior injuries to this area?
Please give more info for accurate pricing. Even then, though, you can't go based on what you get from someone here. Every accident/injury case is different and they don't have a blanket $ amt for certain injuries. |

About half a million bucks.
Enough to buy a house...cash.
No, just kidding. Once I hit somebody broadside and wound up paying $50.00 to fix his car.
That was in 1966. |
