I'm certainly no expert, but my understanding is that it's very little. The person would have to prove their emotional pain and suffering was serious enough to have major negative impact on their life--unable to work, for instance.

The two lawsuits I know the details of where the person sought damages for emotional suffering did not pay anything for it. Each involved an auto accident death of a loved one. If that level of suffering isn't paid, it's hard to know what ones are.

According to my professors in law school: nothing.

Emotional pain & suffering is impossible to measure, and there is usually no way to place a dollar cost to it.

Since every claim has different circumstances and severities, you can't get an "average". A particular state's laws regarding insurance has as much, or more, to do with settlements than anything else.

You don't get paid for emotional pain and suffering.

Now, some folks get paid for physical pain and suffering. However, there is no way anyone can give you an average cost.

The amount of a settlement depends on a whole bunch of stuff - including but not limited to - the coverage limits available, the injuries received, the treatment, the effectiveness of the treatment, any permanent injury, the physical damage to the vehicle (if car wreck), how the injury occurred, if gross negligence was involved, the venue/jurisdiction where the case would be tried.

Emotional pain and suffering can last a lifetime; a person suffering such effects can be receiving help from the best doctors in the world but in the long run, emotional pain and suffering never really leaves your mind. Such person can work on hiding these effects to help them move forward in life but it's always possible for an event to trigger these effects.

A person could settle for a few million dollars which could last them a lifetime and they might be happier, but the emotional will always be there.
