i was doing overnights at work, and i broke my toe. [i'm a HUGE klutz] but anyway. my parents told me to go through workers comp and i had to go to a different doctor and everything.
i have no idea what the helllll it is. and i was wondering if it's something my employers wouldn't like. cause i'm not the type of person that would sue my company or anything like that because i got hurt. and i was just wondering if it was something like that...

I understand why you are nervous about making claims that your employer would have to pay, but since you were hurt in the course of your job you should put the claim into your empliyer to go through their workers compensation insurance coverages.
They have coverage in place to cover your injuries on the job, you would not have to sue them to get the coverages, most on the job claims are covered with very little to no investigation, (depending on size and severity)
The insurance company makes your employer ultimately responsible for your safety, while you are at work your emplyer should provide you the correct education and access to the right tools so you can do your job correctly. That is why your employer carries the coverage. So that in case something comes up like what happened to you, they have the coverage they need to take care of the claim.
The insurance company will probably have you complete a First Report of injury form so they can have all the incident information from you and your employer in writing.
I think that it would be best for you to put in the claim under your employers workers comp insurance, that way if you have later pain and suffering that you need to claim you can show how you did your part by initially putting the claim through them.
Go to your supervisor and explain that you were hurt on the job and that you need to put in a workers compensation claim

"Worker's comp" really means "Worker's Compensation."
When a worker gets injured during work hours performing work duties, the employer is responsible for assuming responsibility. Such responsibility includes paying for any lost wage, paying for medical treatment, and any loss you incurred by your injury.
It has nothing to do with suing your employer. It has everything to do with your employer had a responsibility to ensure your safety. Somewhere in your work area, typically in your break-room, there is a HUGE poster about worker's compensation. You are entitled to use worker's compensation, and your employer is required to provide you with the assistance you need.

Work comp is insurance that your company pays for their employees when they get hurt at work.
Lots of people get hurt at work, the reason that work comp was set up in the first place is to avoid litigation. It was a way for the company to be protected from stupid law suits. Insurance company are normally the ones that provide the insurance, however some states are monopolistic states such as Washington state which work comp claims go through the government.
When you get hurt at work you should report to your employer as soon as possible, no matter how stupid the injury is. You will be examined by either your regular doctor or a work comp doctor. Some doctors don't or are not certified by the work comp department. Each state has different rules and regulations.
Some employers don't like work comp because it the more they get the higher they got to pay, however thats part of life. Some employers fight cases such as back injuries as well as hernias and what not. Your injury to the toe shouldn't cause much problems at all.
Work comp also helps protect the injured party. There are laws that if you miss a certain amount of days you should be entitled to Temporary total disability (TTD) which pays you while you are off work. It can be 2/3 of your average weekly wage, however some states are different as its based on your marriage or dependents.
Work comp also helps the injured people who lose a certain part of their body, such as amputations, range of motion and such. If your toe was so badly injured that you had to amputate it than you would be entitled to an award called permanent partial disability/impairment, there are normally formulas that help the adjuster figure out how much money you should get.
Died at work? Work comp has laws for that too. If somebody died at work and then that person's family will get either lifetime benefits or a lump sum award and funeral cost. Again each state depends on it. However only the dependents and the spouse can get it, your mom or dad can't. If that person who died didn't have a spouse or dependent than the money goes to the state fund.
Work comp claims can go to hearings, normally when there is a disagreement of whether the injury occurred at work. For instance, if the guy who was obese died at work from a heart attack then questions come up like, did the claimant have prior heart problems before? Did his obese status was the major contributing cause? What was he doing?

You should have reported the injury to a supervisor or human resources immediately or ASAP. There is alot of fraud associated with workers comp and injuries could increase their premiums. If you have a good relationship with your employer, discuss it with them and the exact incident on the job how you broke your toe, chances are with a good explanation you will compensated for time off and medical bills incurred. |

You NEED to file the accident report with your supervisor, at work. That's step one.
It's a NO FAULT coverage, required by law, in every state except Texas, that says in exchange for providing you with medical payments and lost wages, you cannot sue the employer, for any injuries that happen during the course of your employment.
But you HAVE to notify your supervisior - they are the ones who start the claim process. |
