First off - keep in mind - any compensation she gets for the ruined shoes/clothes is going to be depreciated. She will not the get replacement cost. What they owe her is what she could have sold those clothes and shoes for had they not been damaged.
So, if she had a yard sale- what would someone buy those clothes and shoes for?
Probably not worth the hassle to get the $5.00-$10.00 (five to ten dollars) they would pay. |

on what grounds does she want compensation, is it the company's fault that someone removed the drain cover ?.
is it there fault that your niece 3 year old went and put her leg down it. dose your niece always let her 3 year old run around a station platform un attended if she does is it any wonder she got hurt ?.
we all have to watch where we are going we cant just put or foot in it then look 4 someone to blame |

get on your computer and in the search bar put insurance ombudsmen, send an email to them explaing what happened and they will take up your case free of charge. |

you have to hire a lawyer, write a letter and eventually proceed with a suit. Obviously the insurance is not going to send you money unless you threaten them with a suit. What usually happens, is that no suit is going forward and the insurance will settle for a small amount out of court instead of going for an expensive trial (expensive for you and them). Usually for small things like that a letter from your lawyer should be sufficient for them to come to you and negotiate a small amount (expect $5 to $10k max). |

Rather than waste a lot of time and emotion on this, go straight to the Insurance Commissioner in your state. Insurance companies pay a whole lot of attention when the Insurance Commissioner of the state where they reside sends a complaint on to them. It gets priority attention AND the company must send a satisfactory explanation back to the insurance department within about 15 days. If the parents lived in Ohio for example, they should just do a google search on Ohio Department of Insurance. There you will find all you need to know about the address to file complaints. Contact the insurance company again and tell them that is not acceptable, they always try and get out of paying and hope you will just drop it and not bother with the claim |

idk about all these other answers- I agree with Prince Henry.
Sometimes kids just step in crap and you deal with it. Don't be so quick to sue and file claims and etc etc. |

I don't know about C2C but Network Rail should be advised and you should enclose a photograph of the offending drain area together with, if you have it a photograph of the injury.
The Citizens Advice Board will give you addresses and further advice.

Drains should be covered. You have a definite case, go and see the citizens advice bureau. I suspect if they write a letter you will get a payout for ruined clothes and shoes and probably more for all the hassle. |

My first question would be who is C2C? Are they a company in connection with Network Rail or were they the contractors carrying out the work on the drain? Assuming they're the contractors and the claim has been repudiated because they took due care & attention with health & safety to secure the permiteter of the drains, yet your neice was negligent in allowing he son to go near the drain anyway, then that's a fair case for dismisal of the claim. However it all depends on exactly what's gone on really as your question doesn't actually tell us as much about the background of the claim and what went on as first appears.
