Bob and Joe injured with exact same injury in auto accident. Bob goes to ER and has cat scan - meds $3,000. Joe takes financially responsible route and goes to GP, has checkup and xrays - meds $500. Neither Bob nor Joe need additional treatment. Why would Bob's claim be worth 9,000 and Joe's worth 1,500 when they both sustained same injury?
I am bitten by dog on face. 1 ER visit for sutures. Bill is $500. I have severe scarring. Would me claim only be worth 1500?
I die - no bills. Is my claim worth nothing.
With the cost of diagnostic testing the amount of meds simply can not factor into the value of the claim.

you should ask an insurance company for the money to pay your medical bills and/or repair your vehicle. no more, no less. "pain and suffering" is something that lawyers made up to make them more money to charge their fees against in court. |

It depends on how much actual pain & suffering you had. You cannot claim pain & suffering if you were well enough to go out with friends, party, drive a car, etc. Remember that fraudulent pain & suffering claims drive up the cost of insurance for everyone. If it's legit, then go for it. |

You might not be entitled to ANYTHING! You don't give any info here. It's going to depend on your state laws, if you're no fault, if YOU have limited tort, how extensive your injuries were, and how much damage there was on your car.
You should sit down and ask YOUR AGENT for advice. |

this is a muti facet question. and the answer lies with you. You have to ask your self how bad was the sufering to begin with. and what memories has it left and are there going to be any physical remains of the accident on your body for the rest of you life?
the next series of quesitons would be the moral ones and most people do not think of these when they plan to sue a corporation in the US. How big is the company, i would recommend that you do your research before asking for compensation. What kind of revenues does the company set aside for legal issues? Would your lawsuite make a dent in the corporation? if so, how big?
There have been cases where single lawsuits have bankrupted entire organizations. Yes, it would help you and your family for the rest of your life, but on the other side, would it fire a whole lot of people who would be otherwise set for life. how may pention plan would have to go away as a result of this lawsuite etc...
if at the end of this debate you feel that there is a win win situation, then go ahead with your decision. |
