It depends on the state of the deceased. You should ask the executor of the estate. If you are the executor (as I gather), seek the help of a probate attorney who is familiar with the laws in the deceased's state. It should take less than 1 hour of his or her time to explain this to you. Making a good guess just doesn't cut it. |

In most states, the spouse is automatically beneficiary. Otherwise, it usually goes to the estate, to pay off debts, and is distributed with any estate remaining, to the heirs, by a probate judge. |

I work at a bank and deal with this all the time... if there is no ben. .... the question is is there a will and did the deceased person appoint an executrix/executor? If not, then you can go to the county courthouse and you can become a court appointted executor/executrix and you may have to work with a lawyer... but executor/executrix has access to the estate (that should include all bank accounts, and such)... |
