In most cases market value is established by sources LIKE the blue book but not neccessarily so Retail, not wholesale. If the amount is disputed, an arbitration judge will award what three different dealerships in the area have actually sold a comparable vehicle (year, mileage, condition) recently for.
Also you are entitled to a replacement vehicle until your claim is settled. Once the claim is settled that benefit expires. |

edit.. blue book...quite often you can buy the car back from the insurance company cheap, and have it repaired....the insurance company will only give you liability insurance on that car, after that..... |

Claims adjustor decides. They have guidelines. Usually if the cost to repair is 75% of the value of the car they will consider it totalled. 75% is just a guideline. They are flexible in considering it near the 75% up or down.
If the accident was not your fault ask for a rental car. If you don't have rental car coverage then add it for next time.

They don't use the KBB value, they subscribe to a service. You can get ROUGHLY an estimate of about how much it's worth, if you use the PRIVATE PARTY resale value, from www.kbb.com.
An appraiser will look at the car, and figure out how much it costs to repair. They stop calculating, when they get to the value of the car.
If you've got a rusty 1968 Dodge Dart with 200,000 miles on it, and a broken windshield, that car is totalled. |

sometimes they go by the NADA or the dreaded Black Book, which I believe has even lower values than what most of us think our cars are worth. |
