Who do I sue, the insurance company or the negligent driver?
A girl didn't look and crashed in to my car a couple months ago. I tweeked my back out and had $5,000 in medical bills. Her insurance accepted full liability, and I wrote her insurance a demand letter for all my out of pocket costs and three times my medical bills. I have gotten the silent treatment from her insurance since then. I think I will have to settle in court, my question is, who do I file an action against? I would think that her insurance has an obligation to cover their insured, and I could sue her insurance, but other's have said to go after the driver. I am not going to hire a lawyer and let him take all my money, no way.

Do you not have insurance of your own? Because ordinarily, it would be your insurance company doing all the chasing around for you.

You need to sue the driver, her insurance company will represent her. Also, it may be in your better interests to hire a lawywer, they're better at getting big settlements than you and me.

have your attorney go for the driver. The driver was at error, not the insurance company! The other drivers insurance company will get involved all by themselves anyway.

You really need to have your own lawyer. Never go to a gunfight unarmed. It is your choice, and in most states you can sue to include lawyers fees, but the choice would be to win and pay for the legal help or lose and get nothing.

You have to sue the negligent party, not their insurance. If you name the insurance company in the lawsuit they will have it thrown out. Then you get to start all over again. I've seen this many times so save yourself some time and expense and sue the driver.

The insurance company will defend her and pay any jury award you are lucky enough to get.

You only sue the driver. She will tell her insurance company that you are sueing and then the insurance company will pay you faster.

It would be easier to contract the Department of Insurance or Insurance Commissioner in your state and file a complaint against the insurance company.

Also, call her insurance company and tell them if they do not settle with you ASAP you will file that complaint. Insurance companies do not like it when they get in trouble. If you threaten a complaint against them they usually get moving real fast so you will not do it. Below is a link for California's Insurance Commissioner.

consult a lawyer. I don't believe by demanding 3x your medical bills they will just give it to you. If they have paid your medical bills then they have settled.

You have to sue the driver of the car, and the owner of that car.

Keep in mind, in some states, you can only collect under your own policy for your medical bills. Also, some states, it matters if you are insured or not - if you have no insurance, you can't collect against someone else.

Lastly, there's no "three times medical" rule. That's a myth. IF you live in a full tort state, you can sue for reasonable medical and pain and suffering, which will entirely depend on exactly what the injuries are. It's not hard to wrack up $5,000 in emergency room bills, even if you are completely uninjured. Basically, an ambulance ride, and full body XRays will do that.

So, what you can sue for, is going to depend on which state you are in, exactly what your injuries were, and what your permanent disability is.
