Who is at fault if something is damaged during shipping?
I ordered something off eBay and it was damaged, I assume, during shipping. Who would the responsibility fall to, to fix the issue? Should I try and take it up with USPS or is it the seller's responsibility? The seller is just a normal person not an online business.

Edit: I didn't have the option to pay for insurance on it but I paid the seller $16 for shipping and it only cost $9 so I'm not sure if the seller got it or not.

The seller is ultimately responsible.

All online transactions, including all online auctions such as eBay are classified under Federal statutes as "mail order" transactions and are subject to Federal laws, regulations and guiding principles. Federal law, in particular the laws formulated under the Federal Trade Commission or FTC, governs Internet sales.

One of the guiding principles which governs online sales is that the Seller, not the Buyer, assumes all risk of loss and damage for merchandise he ships to sellers. The seller is responsible for the safe delivery of a item in the condition as represented, in compliance with all the sellers claims.

The seller is responsible for correcting the situation. They may have to contact whatever shipping service was used and be reimbursed for the value of the item... was it insured do you know?

I would contact seller immediately! They should make sure you receive a replacement item.

You need to provide more information like importantly. Was it insured? If it wasnt insured and I saw the box was damaged. I would have refused it or never opened the box in the first place.

If it wasnt insured you will not get your money back from the usps. But you may talk to the seller to see if he will refund you excluding shipping costs.

Call USPS and start with them. I believe there is a minimal amount of insurance when they ship. If it is an expensive item, it would be up to the sender to insure it properly.

It would be your responsibility to have purchased insurance and the shipper would make the claim. If the shipper didn't offer insurance then that's really in their court. If it came by mail uninsured then you're stuck. UPS automatically covers $100 at no cost.

I ordered a computer monitor and when it arrived it was an empty box (not sealed...it had fallen out somewhere). The company I purchased from made the claim, but the person from UPS came to take pictures of the box, etc..

The shipper got a check and I got my monitor. It was a good deal for the shipper because they got to sell two moniotrs.

USPS is going to tell you it's the seller's fault, for not packing adequately. The seller is going to tell you it's USPS's fault, and if you didn't buy insurance, too bad.

You are going to be left holding the bag, though.
