Depends on state....
in many states, your auto insurance compnay is allowed to subrogate payments to you for MedPay coverage. This means that they will go after thrid party for money back instead of you.
Most adjuster guidelines will consider this subrogation as part of claim.
In states where MedPay is not subrogable then your carrier pays medical bills and you get to "double dip" the same bills with the liability carrier. You get paid twice for same bills making you settlement larger.
However, most medical providers now will file a lien against your MedPay and/or liability claims assuring that they get paid before you do. If the liability claim is denied then you are stuck paying bill yourself if MedPay and Halth insurance is exhausted |

I concur that you are ultimately responsible for your own medical bills. Health care insurance may step in and pay and then file back against the any other available coverage. It is the responsibility of the adjuster settling the claim to verify that there is no hospital lien before paying out. If there is a hospital lien then the hospital is entitled to collect first. This will depend on the state that you reside as well. Laws vary from state to state. PIP or Med Pay coverage may be available. If you were working at the time you also may have Workman's comp available to you. Determine what you are entitled to and if you are not sure consult an attorney- (they usually get about 20% of your settlement). |

If you don't settle, it means you will need to go to court with them. Whoever lose the case will pay. I don't know the detail, but, you'd better already have an attorney. |

You are ultimately responsible for paying your own medical bills. It doesn't matter that the neighbor's dog bit you, or the guy down the street hit you as a pedestrian. If the insurance company is arguing that they should not pay, and you think they should, you are still obligated to pay your own medical expenses. The purpose of a lawsuit is to prove your case and get them to own up to the responsibility.
Often you will find that the cases end up reimbursing you for what you've already paid. Be prepared to handle this, as it will not go away. |

You have to pay your medical bills. Sometimes your health insurance and auto insurance will "cooperate" so that one pays part, and the other pays part, but both or either may have an exclusion - ie, the health insurance could have an exclusion for injuries occurring in an auto.
Most policies have a clause in them to prevent "double dipping", ie, getting paid for the same thing on two different policies. You should check with your auto agent for your state specific and policy specific options. |
