You are correct in Texas Work Comp Insurance (WC) is optional, the employer will never get in trouble for not having WC.
The problem for the employer is that not carrying WC does not alleviate their duty to pay the same. It just means that your employer is risking bankruptcy by not carrying the insurance.
Hope that makes sense, just because they do not purchase the coverage does not mean that they do not have to pay the same if a work-related injury occurs. |

According to this website, Texas does have Workmans Comp insurance but you may not be a regular employee. You did not mention circumstances of your employment.

Yes, here in Texas, employers are not required to carry workers compensation insurance. BUT, they're still on the hook for the benefits, the medical bills and lost wages, even if they don't actually buy the insurance.
Because of that, MOST Texas employers buy workers comp insurance. |
