Over the weekend my friend was visiting my apartment and she fell on one of the staircases. It was outside of my actual apartment in a common area. She wants to sue my apartment complex. I called them to report an accident and they said it would be covered by my renters insurance. I don't think this is correct since renters insurance is only meant to cover what is inside the apartment. Can she really sue me instead of the complex? It isn't my fault the stairs are bad and she happens to be a little clutzy! ( i love her but she really is a clutz) |

She can sue them, and whoever owned whatever the object was she fell over. Typically, a renters policy only covers INSIDE the unit, but that policy should defend you, if she sues YOU.
If she goes to a lawyer, a GOOD lawyer is going to name EVERYONE. You, the owner of the complex, the manager of the complex, and the owner or responsible party, for whatever made her fall.
If she's just clutzy, she's not going to WIN a lawsuit. Just because you fall down, does NOT automatically entitle you to a big fat check. Someone has to cause, or contribute to her fall. It's going to depend on how severe her injuries were, how big the medical bills are, and how much she's permanently disabled. |

In theory, she and her lawyer can name anyone and everyone anywhere near the fall. Will they win against everyone? Absolutely not. A good lawyer would name you both in the accident along with anyone else that may have been a contributing factor in her fall.
Your Renter's insurance WILL cover your defense costs, and you can probably expect to be found not liable for this. The only reason you would be found liable is if you had knocked her down the stairs or it was your child's toy that the slipped on or something like that.

first of all Calm Down. She can always sue you, but it doesn't meen she can win. You did nothing wrong so you shouldn't have anything to worry about. She will not get money from you and your insurance will not go up. |

The complex. She did not fall inside of your apartment, but outside your door. If the stairs are in bad shape, that would not be your responsibility to fix them, that falls on the owner of the complex. I wouldn't worry too much, it's not your responsibility to fix a complex that is not yours! |

Even if she does sue and perhaps win, she'll probably only get medical bills paid.
No offense, but your friend sounds sue-happy and is looking for easy money. Accidents do happen and not all are worthy of litigation. |

Keep in mind that if there was not a hazard involved on or with the stairs, she will have a very hard time even finding an attorney to take the case. If they feel their not going to get money out of it, they wont take it...unless she pays retainers and the hourly fees associated with the pursuit. If the stairs really are bad, she definitely has a case and may find an attorney to do it on consignment. I know that anyone can be sued, but I believe that if this occurs to you in this situation, it would be dismissed as the accident did not occur on your rented space. Stairs are the responsibility of the building owners. |

No, she can't sue you. Your renters insurance only covers the property contained in your apartment. If she hurt herself due to a defect in the property itself, then it would be covered unther the complex's insurance. |
