Insurance policies are legally enforceable contracts that are reviewed and approved by the various State insurance departments. The insurance industry is one of the most highly regulated businesses in the USA. As in any legal contract your insurance policy spells out what is and is not covered and your rights are enforceable in a court of law.

Read your policy. An insurance contract states in an insuring agreement what is covered and then modifies that insuring agreement by the use of exclusions. For example a health insurance policy insuring agreement might say that medically necessary procedures will be covered by the policy but will then clarify through the use of exclusions that cosmetic surgery or experimental procedures are excluded.

You say this is a scam. But if you can show that the contract's insuring agreement covers your specific situation and it is not excluded you can take your case to court and not only win a judgment but also receive significant additional compensation for bad faith claims denial. There are lots of attorneys that would be very happy to assist you in pursuing a legitimate case of an insurance company "scamming" you.

(I know that's not what you want to hear but those are the facts)

you can complain to the insurance department in your state as well as your legislators. be prepared with back up.
