There is not enough information here for me to tell you exactly what happened - but here's a guess of what could have happened.
1. The policy was not in force at the time of the collision. An insurance policy that was not paid for - does not provide coverage.
2. The medical bills exceeded the amount of the policy limit - the most the policy can pay is the policy limit. It does not matter how bad the injuries are - the policy limit is the max payable.
3. You filed a claim against your own policy and had not purchased Under-Insured motorist coverage or you did not have sufficient limits of under-insured motorist coverage.
4. The insurance company did pay - per the policy and policy limit - however, since the injured party is a minor - the settlement had to be court approved which means you don't get the money - the court requires that it be set up in trust with the court for the minor's use and benefit once he turns 18.
5. You hired an attorney and after the attorney took his fee (1/3+ expenses) and paid what medical bills he could - there was nothing left over for you. If this is the case (and I suspect it is) - go back and see your attorney and have him explain it to you again. If this is not the case - go back to your attorney and have him explain why the claim was not paid.
If you do not have an attorney - call the adjuster. They will explain to you why the claim turned out the way it did. Granted, you have to hush and not threaten to kill the adjuster and actually listen to them if you want to understand the situation. You will not like what they are telling you - but the adjuster can explain it to you so that at least you understand.
I am very sorry your son was hurt badly. However, his injuries indicate that he was not wearing a seat belt and was ejected from the vehicle. I hope that you and your children will wear your seat belts from now on. Although most states will allow an injury claim to be reduced if you do not wear a seat belt - I can't think of one that lets the claim be denied out right for lack of seat belt.

I guess you also didn't buy health insurance for your kid, or else the health insurance would have paid where the car insurance left off.
Ever walk into a store, and not give them any money, but expect them to hand over the cigarettes anyway?

You statement is unclear. Is Allstate your insurer or the other party's insurer. Are they denying the entire claim, and if they are what was the reason they gave for denying the claim. Did they pay out the maximum under the policy? Please clarify. |

If the other party didn't have much coverage they may have run out. You have the option to purchase in most states Underinsured coverage equal to your liability coverage. Your insurance to may not have had any benefit remaining to pay. You should check with your insurance company to see if you could have submitted a claim that could have been use to help cover your out of pocket. There is not enough information in your paragraph to fully understand what is going on. |

1st let me say, Sorry to hear you had problems with a claim.
2nd, your allstate agent has nothing to do with how much Allstate pays on your claim. That is decided by you, when you purchase your policy. You are given the option to have up to 500 thousand dollars in coverage. You must have chosen a smaller dollar amount. If you had chosen 300k or 500k in coverage, you would not have incurred any of the expense out of pocket.
You didnt mention in your details exactly what your policy limits were before you had the claim. Did you decide to go with state minumum requirements of 25k so you could have a cheaper monthly premium? Keep in mind - when you go to your agent and ask for insurance, that whatever limits you pick, that is all the insurance company will pay on a claim.
When I was an agent, I had alot of people who would claim that the policy that gave them 300k in coverage was too expensive. They would then opt out for state minumum requirements which only gives 25k in coverage. I would warn them - that 25k is not very much when it comes to medical bills, but they still go with it. At that point - its their choice. Cheaper monthly premium - vs - higher coverage in case of accident.
If you want your policy to pay 200k in expenses if a car accident happens, then you have to buy and pay for a policy that pays for 200k in expenses. You cant buy a policy that only covers you for 25k and then expect the insurance company to pay 200k. Thats just common sense. (just using that as an example)
You might try pulling out your auto policy, and see how much coverage you are paying to have. If you think it is too low, call your agent (or switch agents if you dont like allstate) and pay for a policy that pays higher limits. You can usually get as high as 500k. I can tell you as an underwriter, it doesnt matter what company underwrites you. We are never going to pay out damage exceeding the policy limits you are paying for.
Its better to be safe then sorry. With todays $ for medical expenses, go with the highest policy limits you can find. Your case is a good example why not to go with the cheapest policy you can find. |
