The stairs of my back deck (put in long before i purchased the house) are falling apart. I havent filed any claim or called them as of yet but just wanted some information before i start the process. While not attached directly to the door, it is the only way to enter and exit from the rear. I know I would have a deductible and all. I am assuming it should be covered as if someone were to fall as a result leaving my house it would result in a claim but a friend said it might not be. Thanks in advance. |

If the stairs are falling apart due to wear and tear -- repairing the stairs is not covered.
Since you know the stairs are a falling hazard -- I suggest you get them fixed now. If you don't get the stairs fixed and some one falls -- the adjuster will investigate coverage then. If the insurance coverage does not apply - you can be held personally responsible for any injuries your stairs cause to someone. As a property owner you have a legal responsibility to maintain your property.
Since you have now posted on a public forum that your stairs are falling apart and a safety hazard......go fix your stairs now. |

sorry but that's a maintenance issue and you better get it fixed BEFORE your company inspects or they will not continue coverage as that is a huge liability risk. It is not covered as stated above. |

Claims are for catastrophic events, did it catch on fire, get pelted with hail, or flooded? No. People do not understand the concept of an HO policy, it's not to cover fluffy chewing up the carpets, your kids coloring on the walls, or some old as hell deck falling apart, that's just regular maintenance. You probably have a 500 dollar deductible and to fix the stairs is probably 600 or 700 hundred. So you want to pay your deductible, have a claim on your record AND have your rates go up over something this small? Some companies will even drop you after a claim. Plus, if it were a pre-existing condition, they won't cover it. I'd really think this over if I were you. |

The stairs on your deck are covered against damage from direct physical loss from an occurrence.
This usually means that the damage has to be sudden and accidental. If damage occurs to your stairs in this fashion, coverage should exist, unless there is an exclusion applicable.
Unfortunately, your description seems to be of the "wear and tear" and "lack of maintenance" variety. If this is the case, I can pretty much guarantee you that your insurance company will deny any claim you make for repairs to the stairs.
However, if someone trips and falls on the stairs, you do have liability coverage on your Homeowners policy to cover any injury claim made against you.
My advice to you is to get your deck and stairs fixed before someone hurts themselves. Unfortunately, you will have to pay for that yourself. |

it would cover the stairs if they are attached to the building as they are classed as a permanent fixture or fitting.
with regards to making a claim, an insured peril needs to have occurred. this means that an event covered by your insurance has to have happened to them, eg. fire damaged, storm damaged etc. if they are just falling apart due to old age, it is classed as wear and tear and not covered under any insurance policy. it is considered a maintenance issue.

They are probably covered. It is generally thought of as part of the house. However, it sounds like normal wear and tear and that isn't covered by insurance. If it were damaged by fire or snow that would be another matter. The only protection you have for this type of thing is a contractors guarantee, which has probably long expired. |

The stairs of your house is something that you would be covered for, if the reason for the damage that was not a maintenance, wear/tear issue. In this case, the reason for the damage to the stairs is going to be called "negligence". Basically, you knew they were in a bad shape, and you didnt fix it, so the insurance is not gonna cover this.
Your homeowners insurance only covers accidental fire/hazard. Sudden fire, water damage, wind/hail, falling object etc. Damage over time is considered something that could have been avoided and your responsibility to take care with proactive measures so that it doesnt go further than that.
If somebody is to fall or slip on your stairs, and decides to sue you, then yes, you will be covered up to the amount of your personal liability coverage of your policy. Although, the adjuster might determine that the slip/fall could have been avoided should the stairs have been fixed.
Regardless, for future references, any structure that is not attached to your house, but is on your property, will be covered under the "separate structures" coverage. If the structure is attached to your house, then it goes under the regular dwelling coverage. |

Yes, homeowners insurance includes anything attached to the structure, as covered property. That would include the stairs.
No, falling apart from disrepair, is NOT a covered cause of loss. This is a normal maintenance issue, so the insurance company isn't going to pay to replace this.
Now, as far as liability goes, you know anyone who lives there, isn't going to be covered under your homeowners policy - resident relatives, and the insured, are excluded.
There is a little read exclusion in the standard homeowners policy, saying that the policy won't pay for expected or intended injury. Um, you're expecting a loss here. I think the insurance company would have a really good arguement for NOT paying a liability claim, as you know that the stairs are ready to collapse, and you haven't fixed them.
So, if you want to take the chance, and maybe be out of pocket for tens of thousands of dollars for an uninsured liability claim, don't fix the stairs.
Or, pay a handyman $500 or so, and have new stairs installed. |
