If so, could anyone ballpark a figure for me? Please no partisan or biased answers, if you have disgruntled emotions about either Obama or doctors this probably isn't the forum for you. Additional Details Thanks for all the answers, I post the question because 1) Obama specifically addresses the issue on his website, 2) over 80% of malpractice suits are settled in the doctor's favor, so no one has to worry about lawyers getting more suits because that was never the real problem, 3) it has been said that insurance companies have been losing money on their investments and are taking it out on doctors despite the fact that there hasn't been an increasing amount of winning malpractice suits. |

As an interest group lawyers and lobbyists would have a financial interest in at least maintaining the number of malpractice suits and the size of judgments. The fact is this group would like to see laws and procedural rules amended that would allow more, not less, malpractice suits.
If, as a lawyer, you perceive that Sen. Obama, who himself is a lawyer, would agree with your point of view and would propose changes that would reduce restrictions on bringing lawsuits naturally you would contribute to his campaign because it would be in your financial interest to do so.
That is why as of Sept 29th lawyers and lobbyist have contributed $27,944,975 to Barrack Obama and only $10,249,244 to John McCain.
Lawyers aren't voting with their dollars because they think Barrack Obama is going to reduce lawsuits. |

TJ, my thought is that you really think your question is serious. In that context, I offer a thought for contemplation: Trial lawyers are supporting BO. If lawyers can sue more often, and/or receive larger settlements, do you really believe insurance companies will NOT have to pay out larger settlements?
If larger settlements are awarded, how would you perceive the insurance companies could possibly lower their rates? |

To think that any politician will actually do anything is naive. Take jobs for instance. Politicians don't create jobs. Businesses create jobs, therefore taxing businesses excessively directly affects the ability for companies to create jobs.
Just a thought. Specific to your question without tort reform which would have to happen in the Senate/House there will be nothing but increases. Ballparking an arbitrary number is impossible. |

Well I guess if the government plans on taking over the insurance companies, or outlawing lawsuits (which they won't, you do realize most politicians-as well as Obama-are attorneys? right?).
My guess is they plan on taking over the insurance companies, it seems we are becoming a complete government state.

There has to be give and take in that plan. If he's just going to order insurers to lower rates, then there has to be a concession to the insurers in order for them to keep from going bankrupt or refusing to issue policies altogether. Either: a law will have to be in place to limit the amount that can be awarded in a medical malpractice suit (State jurisdiction, therefore not going to happen); the federal government will have to assume a portion of the risk (which means all taxpayers are on the hook); the federal government will have to take over insuring medical malpractice (all taxpayers are really now on the hook). Any way you look at it either the individual or the taxpayer would be taking the hit with such a plan. |

Don't overestimate the power of policiticans. They usually only screw things up, not make them better.
Every insurance market where politicians have tampered with it, has been a disaster. Look at FL homeowners and NJ auto, for examples. |
