Will i get my money back?
i just recieved a package froma seller on ebay. the thiing was tottally ripped open and empty! the post office stamped it w/ a " recieved w/ out contents"stamp. is there anything i can do even though i did not have insurance on it? it was obviously stolen. but i didnt think to get insurance for a bunch of cookbooks! i thought it was only for breakables. please help, and tell me what i want to hear!
Additional Details
i only say that is was "obviously stolen" beacaue it looks like it was just ripped open down the whole side, and it wasnt very worn from handling, so i dont know how it could be in near perfect shape, but the whole side was completely ripped open. i too have gotten a package once that was nearly ripped in half, from wear and the post office had to put a bag around it. it was very worn tho. i dont know if this helps. doesnt help me!

'It was obviously stolen', is a presumption on your part.

Perhaps the parcel was not properly wrapped and sealed.
Though I do receive parcels on my mail route without contents, it is an occurence that happens only once or twice a year. More likely the goods were separated from the package in handling. That is why it is important to attach an address via tape onto any items in parcels that are being shipped, just in case the parcel opens up.

Insurance is cheap, and should always be purchased in these circumstances.

How did you pay? Did you use paypal? You can open the claim, and the information will be received. Enter a dispute for item not received AS DESCRIBED. If you enter a dispute for Item not received, all they have to fo is give PayPal the tracking # and they are covered. If you win the dispute, you will get your money back.

If you didn't use paypal, you can still file a grievance with eBay. But, they can't get you your money back. I can't believe the P.O. accepted an empty package!

Good luck Hon.

Well, no. That's exactly what insurance is for. If you could collect without buying it, no one would buy it.

Insurance on breakables is stupid, through USPS, because it doesn't cover if "breakables" break during shipping. That's excluded.

Depends on if you used PayPal or not.. You can dispute the payment through them and send a fraud alert to ebay. An investigation will be conducted and you will be notified if you will receive your money or not.

In addition to filing the claim either through paypal or ebay, you should also notify your local post office that you want to file a complaint. A friend of mine had arranged recently to receive printed matter from a private party - he received a duvet cover instead - apparently a number of packages had been damaged and/or opened. They stuffed in what looked like it fit, without any consideration for what might have been in the contents. It's essentially a cover up for either an honest mistake or an out-and-out theft. Filing the paper work allows the post office to improve their performance in the future, because they can then identify where the problems are occurring and, hopefully, fix them.
