My mother-in-law passed away. I know she had an insurance policy for my husband in case she dies. The problem is the medical examiner's office said it is a suspected drug overdose. I"m assuming they meant prescription drugs because she was on a lot of them. If she was drinking alcohol and taking her normal prescription which caused her to die would the insurance company deny the benefits? We need the money to pay for the burial. |

The only way to know is to contact the company and see what the plan covers. Usually suicide can stop benefits but only in the first two years. It all depends on what your plan says. You don't even know if it is burial insurance or life insurance or something else. Find that policy.
This may sound crass, but when I die I want to be cremated and the ashes placed in the plot my in-laws bought when my husband was young. You do not have to have a burial. You do not have to have an expensive casket or one at all if you are being cremated. Both my in-laws had that kind of burial at their request and it was what I wanted even before I met them. It was inexpensive and very meaningful to both of us. |

It depends upon the details of the insurance policy and the details of what the examiner's office said. Most policy's don't pay out if it was an intentional suicide, but just because it was a drug overdose doesn't mean it was suicide. Maybe she got confused and took too many of something, maybe she didn't realize that she couldn't mix certain drug combinations, or maybe she didn't realize that she shouldn't drink while taking certain drugs.
If it is declared a suicide the insurance probably won't pay, but an overdose doesn't automatically mean it was suicide.
You should try to collect the life insurance. If they deny your claim you should have an attorney review the policy and the other details of the case to make sure that the insurance company isn't trying to screw you out of a settlement that you are entitled to.

IF she's held the policy longer than the contestable period - 2 or 3 years - then the policy will still pay out.
But "having an insurance policy for my husband" means she has a policy, if HE dies. If she has a policy ON him, it doesn't cover of SHE dies.
