If the person driving and driving is killed and injuries or kills someone else and/or causes damage, yes that persons insurance will pay for the injury and/or damage to the other party.
It does not matter if the person drinking lives or dies, if that person causes injury or damage to someone else, that persons insurance will pay for the injury and/or damage.

From what research I did, they don't have to - there was a case where the insurance company won and didn't pay a widow after her husband died. And another article seems to imply it has more to do with the actual policy you elect. |

Probably not. Being drunk isn't an accident it was within the persons control. I would think the only way around that might be if the accident was not caused by the drunk person. Then maybe there might be a loophole. These are just my opinions. |

Yes. The only reason(s) they wouldn't or could get out of it is if the drunk driver lied on the application (i.e. had a drinking problem that he/she didn't disclose). Cause of death usually doesn't matter. It only matters if they lied on the application and got the policy under fraudulent circumstances OR if they commit suicide within the first two years. Regardless, after two years it's not contestable anyway, so assuming the policy was owned for two years you can pretty much die from anything or any cause. Always read the exclusions for YOUR policy of course. |
