I live in Florida, and State Farm's policies will not cover suicide for the first two years the policy is in force, but then that restriction is lifted. I don't know if it's Florida law, it may just be left up to the individual insurer. You have to ask and/or check the policy.
I had a client who found out he was terminally ill and after satisfying himself that it was incurable he visited me and the other agents he had coverage with and asked this same question and a few others in a general conversation about life insurance (we were unaware of his diagnosis). After being assured that suicide was covered for policies in force for more than two years he went home and committed suicide a few days later. His family didn't know that he was terminal, either, until they read his note.
All of the policies paid. It was very sad. |

It is not a matter of state law. Read the specific policy. All have some suicide exclusions. |

This is not state law, this is up to the company to decide whether it pays out or not.
The industry standard is a 2 year suicide clause. If someone commits suicide within the first 2 years of the policy being in force, the claim will be denied automatically. If suicide happens after 2 years, it will still be investigated (just as any claim would be), but it likely would pay out.
This clause has become an industry standard because unfortunately some individuals felt it was better to take out an insurance policy, commit suicide and make a fraudulent claim, rather than owning up to thier financial problems.
Regarding the terminal illness mentioned above, many companies will pay out a claim while the insured is still alive if they are diagnosed with a terminal illness. The insurance company views this as a "He's going to die for sure soon anyways, so we might as well let him see the benefits and value from the policy." That is likely why that claim got paid out....whether he commited suicide or not, it wouldn't have sped up the timeline of a claim significantly.
Your best bet is to check your policy book for exact details on what your companies clause says, etc. |

Most will pay a death benefit after two years regardless of the cause of death as required by state law. But you really must read the policy.
Note that the contestability clock resets if you modify the policy in any way. Insurers will often offer better rates or benefits after a year or two for this reason. |

The Insurance Law for life insurance that each agent learns while training for their license is a 2 year period of time, suicide clause. There is also an incontestability clause along with that which is also 2 years. |

EVERY policy will exclude suicide during the first two or three years, the contestable period.
And it's not the STATE that has the suicide clause, it's the company. So, most policies WILL pay for suicide, after the contestable period, IF there isn't a suicide exclusion on it. And if the insured has a history of mental illness, there is likely going to be a suicide exclusion on it. |
