Hi! i got in a car accident about a year ago. Come to find out a year later that the lady that hit me is suing me for $7K. I just went to court but the judge said that the case will be put in submission and that i should know his answer as to who won in a couple of days. I was told that for sure, i was going to have to pay because the police report says that it was my fault. Now, i know that wether i win or lose my auto insurance is taking care of everything. Wait a minute - didn't you tell the insurance company you were being sued?? Didn't they provide you with an attorney to defend you at the lawsuit?
Police reports DO NOT determine fault. Your rates will NOT go up a second time if you lose the case.
And if you don't believe me, ask your agent. You're paying them to answer all these questions, you know! |

Duberino (spelling??sorry) is correct. As for the person pimping an attorney in their area...your insurance carrier will provide you with a defense. That is what insurance is for. There is no reason for you to pay for an attorney out of your pocket. |

If they are already surcharging you for the accident then they shouldn't be able to surcharge again. However, if they technically cancel your coverage then offer you a renewal in a less-preferred writing company... they can offer you a higher rate to keep insuring you. In this way they can hit you twice.
Remember - insurance law is a state by state thing so it helps to specify in which state you reside. My comments could be irrelevant because I work in NY |

It is likely, yes. Depending on how long you have been a customer and your overall driving record, you could be facing not only bumps in your monthly premiums, but also non-renewal.
If it makes you feel any better, I have been a customer of State Farm for over 10 years. They have replaced two vehicles for me (one was MY FAULT!), and a least two or three other little bumps and bruises to my own and others vehicles along the way. I have only had two tickets in ten years and while my rates jumped a little (under $20) I am still covered by them, so no worries for you...hopefully. |
