No. It's not a "liability" situation - you weren't negligent. Your friend will have to submit the claim under his "comprehensive" coverage on his auto policy. If he doesn't have comp, he could try to sue you, but he'll lose, and you won't have to pay. |

In order for your insurance to pay for the damages there has to be negligence on your part. Any homeowners liability policy will only pay if their policyholder is negligent. Just because you owned the tree that fell does not automatically make you negligent. You have to be negligent in some way.
If the tree was known to be rotted and weak and you were warned about it but failed to remove the tree that would constitute negligence. However, that does not appear to be the case here.
They will have to present the claim to their own automobile policy under the comprehensive coverage of the policy. |

No, it will not because it was not your fault, the wind blew the tree down. Their auto policy will pay if they have comprehensive (otherwise known as other than collision) coverage on their policy. You have no control of storms and the wind so therefore you are not liable. The ONLY time you could be considered liable is if the tree was dying or dead & you KNEW it was dying or dead and did nothing about it. Any person making a claim against your homeowners policy has the burden of proof to PROVE you knew. Usually this is done by certified letter to the homeowner from a person that thinks the tree is in danger of falling. Some trees can be sick & show no signs, they still get leaves & look OK on the outside but be rotten on the inside. I hope this helps you. |
