Will my husband get my life insurance?
If I am still legally married but seperated for the last 8 years can I make my boyfreind benificery on my life insurance without giving my husband any? I live in Tennessee

My question is this: Why would you want to make your boyfriend the beneficiary on your life insurance policy?

Yes, you can take it out of your husband's name (only if you are the owner of the policy). But, in my professional opinion, it should be made to a family member, or your estate, until you are remarried, unless your boyfriend has an insurable interest, and stands to lose financially in the event of your premature death.

If you and your boyfriend own property or a business together, then that would be a good idea. If you do make him the beneficiary, then he should also make you the beneficiary of his policy.

You can name anyone you want as beneficiary on your life insurance policy. Someone doesn't get "automatic dibs" just because you're married to them. You can change the beneficiary to your boyfriend, the mailman, your vet, or even me if you want.

As long as YOU are the owner of the policy, YOU can change the beneficiary.

If you pay the premiums, you can change your beneficiary at any time to any one you chose.

You do need to finalize the divorce though. 8 years is long enough.

If you own the policy, you can designate anyone to be the beneficiary.

I agree with James. You should only make your boyfriend your beneficiary if you have kids or property together. You can make anyone you want the beneficiary. It is always best to make the beneficiary your kids or a relative.

If your husband has young kids with you then you might want to leave him as beneficiary if he is reponsible for your kids or if the kids would end up with him.

There are many issues in deciding a beneficiary such as property, business, minor children, custody of minor children, ect. You should call your insurance agent and make an appointment if possible.

Explain your situation and get a professional opinion. This is what you pay agents to do. Serious mistakes are make if you pick the wrong beneficiary. Be smart and get some professional advice. Insurance Agents do not charge extra for it. It is included in the premium that you pay for the life insurance. And, if you have a lot of assets, then you should also call an attorney for financial advisor for a trust and/or a will. This is not legal advice.

Good Luck.

penny c, Life insurance is actually very flexible. Since I'm from Hawaii I'm not familiar with the Tennessee regulations, so I suggest you visit a nearby insurance agent. http://www.goodinternetdeals.com/Life-Insurance.html They should be able to assist you.

If you own the policy (i.e. pay the premiums and get the bills) then you can change the beneficiary to whomever you want. You'll have to contact the insurance company for the proper forms.

Now if you get divorced down the road then the court may make you change it back as part of the settlement depending on what you 2 agree to, but as of right now you shouldn't have any problems.
