My father in law died recently and we have had problems with his bank account because he didn't leave a will and my wife told the bank that she has an older brother , who has not been in touch with the family for well over a decade, so now we have a problem with probate. Her dad also has a small value life insurance policy which has been paid by my wife for the past 10 years ( but it is her late mother who was the proposer on the policy) and the insurance company have our address for the collection of premiums. We have recieved a claim pack from the insurance company and one of the questions is " how many children are there?" I am really tempted to put 1 ( my wife ) but would they check and find out she has a bother ? |

I sell insurance for a living and have dealt with this before. Typically ONE living child can fill out the forms but you do need to include any siblings in the packet. In my experience however, unless your father specified how to split the death benefit among his beneficiaries you shouldn't have a problem receiving the death benefit all to you. Be honest. Insurance companies may move slowly and probate even slower. However; if this is contested, it will surly come up. Be sure to enclose a letter stating the situation stapled to the form so that it gets read. I would even call an attorney first. Have someone call the insurance company and ask the questions for you. Get the name of the person handling the claim. |

Track the brother down and inform him of the death and probate issues... There are "lost loves" sites where you can post for free, OR pay people search the $30-50 and they will give you all sorts of info to track him down... IF you choose to lie, and he later turns up, he can file charges... |
