jaye | Would you file for Worker's Comp if you were me? |
Here's my story. I recently gave notice at my job at a custom frame shop. This past Saturday (my third to last day) I tripped and fell and broke my foot right after clocking out. I live in Pennsylvania. Everyone says I should get worker's comp to pay for the missed work. I don't know if it's worth the hassle. Any advice would be great! |

OK, first of all, you may or may not be eligible for benefits. PA is NOT an NCCI state - so the comp benefits are a bit different.
Also, regarding the lost wages - IF you were unable to work at the custom frame shop for 6 days on a doctor's order, AND you were scheduled to start a new job, then you'd be eligible for the lost wages, until a doctor returned you to work.
It's highly unlikely that you'd be unable to frame, because of a broken foot. You could do it sitting down. So I don't think you'll get any lost wages. AND, if you didn't have a new jo lined up, your benefits would cease the date your quitting took effect. |

If you were still on the property and had not left then yes you should file for workers comp. This will assure that your medical expenses are paid for. This will also help you if there is a problem with your recovery and return to work is delayed. I would not milk the injury and return to some type of employment a.s.a.p. because workers comp only pays a percentage of your wages but will cover all medical expenses including any perscriptions. It wont be a hassle as long as you are honest. |

Yes, you should file. You were injured at work, and have medical bills. It is worth it. You may also want to consult a lawyer that specializes in workers comp and personal injury law. I hope you feel better soon. Good luck. |

Workers comp is really to pay for your medical bills more than anything. Obviously, you had some if you broke your foot. Did your insurance pay for it or was it out of pocket? If you had to pay for it yourself, I'd say go for wc....if insurance covered you, don't bother. |
