If you were rear ended on a friday afternoon, had minor injuries to your back and neck, but are ok right now for 500 dollars? I went to the doctor, and he said nothing was wrong, and prescribed muscle relaxers. The pain is now gone, and it wasn't that that bad to begin with. what would you do? |

I'd wait a month and see if the back pain recurs. $500 is nice, but a bad back last a lifetime (I know, I have one) and you surely don't want to release the liability of the injury for a quick buck. Mine has cost 10's of thousands! |

I aree with mom of T..... Go get a second oppion. Sometimes damages doesnt show up until later down the road...
You dont want to settle and find out later that something is majorly wrong and is going to cost you thousands of dollars... |

I'd wait for at least three months before settling just in case. I would suggest that you tell the adjuster thank you for the offer but that you want to wait for three more months. Really freak them out and suggest that they "diary" their file for 90 days. If you use the word "diary" the adjuster might assume you have talked to another adjuster or attorney and they may be more generous.
I suggest the three months because summer is coming up and people are more active. If something is ever going to come up with your back/neck you'll know by the end of the summer.
Once you settle and sign the release form that is it...forever. So be careful and patience.
The $500 is the "nuisance value" of your claim. Adjusters are under terrible pressure to close files fast. So when you get in touch with them in 90 days they might give you a little more money if you ask for it. Just make sure that they either pay you or your insurance company for the medical bills you incurred. |

Been there ...hope you are feeling better. I was in an accident (rear ended) in high school. I felt fine the next day and said 'no big deal I'm fine' and settled. The problem is that about a year later I started to have problems with my back and started getting severe migraines. I went to an Orthopedist and apparently the accident did more damage than the original doctor though. I have 2 buldging discs in my neck and 3 in my back that cause the migraines. There was never any other trauma to my back other than the accident . So from personal experience I would not settle but ultimately the decision is up to you. |

I would settle for what you can get. In this case $500. If you signed anything holding the responsible party harmless...then you would have no rights especially if you cashed the check. Even if you have a relapsed health wise. try to get a little more, |

Ask if they'd go to $1,000, and if they don't see if they'll split the difference for $750.
and settle. Because without anything wrong NOW, you're not going to get more offers later, unless something DOES crop up. |

I think you should take the settlement, unless you are "out to get" the insurance company. You could claim your injuries are worse than they are and run up a bunch of bills by going to a chiro, but that is just dishonest. Basically the insurance company is paying you to get you off their back. $500 sounds like a good deal to me. |
