im 17 years old and will be 18 in 4 months. i have a job and i am a 3.4 GPA student. i was in a car accident about 6 months ago and my mom persued a law suit on my behalf ( againt my wishes) she sued my best friend ( the one who was driving when we wrecked) 's insurance company for pain and siffering. my mom was going to take the entire check and spen it for herself. the check recently came in them mail in an envelope addressed to me so i opened it. the check was addressed to me so i deposited it in a bank account that is through my work that my parents have no access to. my grandparents co signed on the account for me. now unless i sign the money over to her my mom is threatening to sue me now when i turn 18 to get the money from me, saying that the money was to be given to her not to me. my question is; is she right? can she sue me for my own pain and suffering check ? |

If she wasn't in the wreck and it didn't destroy her vehicle then she doesn't get anything. If she had someting coming her name would have been on the check. |

~~ I don't know the amount of the check but it would be thru small claims or superior court (causing her to pay attorney fees if Superior court), and there is no way a judge would grant her a repayment of the money. Sad situation, but don't feel threatened, she is just trying to frightening you into giving her, her own way. The money is yours!~~ |

She just might (only just) be able to if she could prove that during your disability, she had to fork out more than she would have had to under normal circumstances, For example your medical bills, time off from work loss in pay etc. Simply said, she suffered losses due to your accident. But on the other hand, since you sued for pain and suffering, nothing to do with her financial losses, I don't think she can |

The settlement was for your "pain and suffering" so the money is your money. She has no claim on it. No attorney is going to take that case, and every judge would simply dismiss it. When you turn 18, you need to transfer that money to an account in only your name and then use it to get a good education. Maybe a law degree!? :-)

The check was made out to you, the money is yours. Let her deal with the insurance company.
Whether the money should have gone to her depends on a few things, one what state are you in? Another is were you as "named insured" on the policy.
I am guessing. You would have to ask the claims rep. But I wouldn't. I would keep the money. Don't rock the boat. Soon you will have a great future on your own anyways. And, your lucky to have such a great grandma. Count your blessings. |
