That is a gift from the family member to the others - not a distribution of insurance benefits. Wills have nothing to do with it. |

Yes, the money that member is giving to other family members is gift money, and subject to gift taxes payable by the member.
It's not life insurance distribution, if someone besides the life insurance company writes you the check. |
