Can a son or daughter fight who is named beneficary in dad's 401k. no will.?

No. You need to have a very expensive lawyer to consider it. It goes to whomever was named on the certificate. No will or trust, then the certificate is it.

In answer to your question, YES you can fight it. Unfortuately you probably won't win so it does not make sense to do so.

It depends for was named beneficary and when but the chances of winning are slim to none.

If anyone other than a spouse is named the beneficiary of a 401K plan, it must be approved by the spouse ahead of time. Otherwise it is part of the estate.

So who was named beneficiary?? If they have someone listed or a charity listed, then no....you won't be able to fight to get it changed. It was his decision and if he was sound when he signed it, it wont be changed.

No. If there is a named beneficiary, that party gets the proceeds. Same as life insurance. It does not get probated with the estate, will or no will.
