Can funds be taken from an IRA or 401k to invest in real estate without penalty?

only from an IRA and only if you're buying a first house, and meet income restrictions.

of course, you can try investing within your IRA, too (REITs, etc.), and if you have a Roth, you can always take out money that was deposited at least 5 years ago without penalty for any purpose.

I would not recommend it any ways becuase your IRA or 401k will give you a better return then real estate. The normal gain on a house is about 6% a year.

you can borrow up to 50% of your 401k, but you have to pay it back with interest. I do not think we hit bottom on the real estate market yet. Even if we are it could go side ways for decades. with little or no gain at all.

Generally, you need an IRA trustee to make the investments. Your IRA probably doesn't have enough money in it to have a diversified portfolio of direct real estate investments.

Invest in real estate through a broker and buy REITs. This way, you're legal and you're diversified.

Yes, from an IRA, but its very tricky. You can buy a house in with your IRA money and it is considered an asset in your IRA. But if you buy it with a loan, then it is like buying a stock on margin which makes a portion of any income and capital gains taxable even though it is in your IRA. Also, any money used on the house for repairs, taxes, closing costs, mortgage payments etc, have to come from your IRA or else it is the equivalent of making unauthorized contributions to your IRA. If you need to make repairs costing $20k but only have $10k sitting in your IRA you are out of luck. Any income from the property, such as rent, or sales proceeds, also need to go back into the IRA. Generally, its more trouble than it is worth.

Also, this would be for investment purposes only. You can't live in the house or obtain other personal benefits from owning it.

You can also withdraw funds from an IRA without penalty in certain circumstances to buy a first home to live in. But this is a permanent withdrawel, not an investment in the property.
