Do i need an attorney to purchase a house in Florida being sold by the owner,i live in NY? No middleman,?
FOr sale by owner in florida, i live in NY, can this transaction be done between us without attorneys or do i have to retain an attorney ?

I can help you out on this, I live in Florida. I bought my first home 15 years ago, without an attorney - the housed damaged from termites. Sold it through an attorney to get rid of it - no questions asked as is. My second home I purchased, used an attorney, the home had a 85 foot sinkhole, I sold it without an attorney - to an investor, no questions asked. However, by using an attorney to buy the 2nd house, I was able to win a lawsuit. Therefore, not using an attorney on the first home, it was a total loss.

Be careful buying homes in Florida, there are sinkholes, there are hurricane damaged and yes, termite homes. People in Florida are frantically moving out of the state, because the insurance has been raised to over $3,000.00. and this may not even cover the total loss of your home. Look into getting a lawyer and have the seller agree to a pull out deal if an inspection does not turn out well before you buy the property.

Its a good idea to get a real estate attorney to make sure everything is in order. And have the house inspected by a licensed inspector. Those and the title company are really all you need to buy a house.

I think the more appropriate question is 'why would you NOT use an attorney?'

If you're looking to save a couple thousand dollars by not using an attorney, that risk is just not worth it. I'm a realtor in California and Arizona... so I'd suggest going thru a realtor :-) But if you're doing a FSBO, you NEED an attorney. The investment in an attorney will only help your investment in your new home. Instead of looking at it like "i can't afford to pay an attorney" Look at it as "I can't afford to NOT pay for an attorney".

gurl why would you want to buy a house in fla i live here and the taxes are thru the roof , prices are crazy and we ALWAYS GET HIT BY HURRICANES which drive up insurance costs that practly no one can afford, think it over real hare , believe me im out of here at the first chance i get, plus the politics of the state is horrible ,, sorry to rain on your day , and i do suggest an atty for any big purchase,

Get the attorney! Unless this ain't your first rodeo, I'd have a lawyer go over everything. Even if you lived in FLA, if you haven't done this successfully three or more times and without a hitch, I'd get the attorney. I know that it's an expense that you can possibly avoid, but this is a corner that you shouldn't cut. (… and ‘yes’, I consider attorneys blood-sucking leeches too.)

you do not have to have one, but I sure would. There may be things in FL law you need to be aware of and does the word scam ring a bell?
