Should I form my own S-Corp or LLC if I trade stocks?
I have a small portfolio of about $70,000 in which I regularly trade stocks. I'm not really a "daytrader," I tend to keep my positions open for about a month or so. Would it be beneficial to me to form an actual company that owns my portfolio in which I trade? I was thinking it may allow me to deduct more of my trading-related expenses for tax purposes. If so, should it be an S-Corp, LLC, or something else?

For an investing company, no.

The only reason to incorporate is to reduce liability. If all your doing is trading stocks there really isn't much of a chance your company van is going to run over somebody crossing the street.

So instead just focus on minimizing your costs, this means staying a sole proprietorship. It also reduces your tax burden. As far as deducting expenses, I really don't think there is any way to deduct trading costs.

Have you thought about bringing other people or you just want to stay alone? Your portfolio is not (yet) substantial to think way over and get yourself worry for nothing.

I agree that the main goal should be reducing cost (commissions, interest on margin trading, etc). You could switch from a retail broker to using direct access brokers assuming you arent using it already. It lets you trade directly with the markets which reduces cost. But then again you would probably have to make a minimum amount of trades in a month to be worth it.

A L.L.C. is primarily to protect your assets, it is giving you limited liability, which in the trading of stock is not a real issue. If your trying to beat the tax man make sure you are not raising more red flags than you need too. You are not going to be writing off that much, unless you are planning to do a site visit, say to Lost Wages to check out MGM stock. Bottom line you need to ask you accountant, because he will know what you overall tax situation is.

Dont bother, you will find no advanatge to these structures. There is no tax advantage and the accoutning costs will be significant. There will be no limited liability because the entity is a sham for your personal trading.
