A friend writes a $400 bad check so he can pay rent. Could I goto my bank and simply cash it?
Or would they come after me for the money when it brings him over the limit?

He's not roommate just a good friend. And we thought he would get all the fee's and have to pay his bank back for the bad check, not the other way around.

The bank would go after you for the money.. taking it right out of your account plus fees.. you'd have to be the one going after your friend for the money later..

His bank would charge him an bounced check fee. Your bank would charge you an overdraft fee, and they would demand the overdraft ammount plus fee from you after the check fails to clear for whatever will bring your account up to $0.00 from whatever negative balance it adds up to.

Its best to not do this sort of thing more than once... The banks are quick to recognize patterns & call the cops, definitely on your friend & possibly on you depending on how straight you can keep your stories.

If the bank is quick with its electronic check cashing mechanism, they may not even cash it at all if his balance was below $400 within a few days of bringing it in.

If you know the check is bad, you would be commiting check fraud.

If you cash a check that you believe to be good, and the person who wrote it knew it would bounce, they've also commited fraud.

of course you can't cash the check, unless you're the landlord and it's written out to you or your company... HOWEVER,

please do not cash the check, if you are SERIOUSLY thinking about it! i personally know someone who was involved in a very similar scenerio... ended up serving jail time, paying back triple the amount of the check and is categorized as a felonist now.

they probably wont even cash it, they will then take it out of your account unless you dispute it which takes months and if he doesnt have it then they wont honor it...it is illegal to write bad checks...sounds like you need a new roomate if he treats you like that, mine did the same thing years ago...I took most of her jewelry till she coughed up the cash then she got her jewelry back...

I had a similar problem with bad checks from an irresponsible tenant once when renting our house once. To avoid paying like $15 and up fees that your bank will charge you and your friend's bank would charge his/her account if the check would bounce due to insufficient funds, the BEST ADVICE is to take your friend's check into the lobby of his/her local bank and attempt to cash it over the counter.

You might tell the Teller why you're there. Anyway, if there is adequate balance and money in your friend's account, the teller will earmark/reserve and process the transaction through and hand over the $400 or whatever amount the check is written for... Otherwise, they normally tell you there is insufficient funds available, and hand you the check back so you can try again at a later date.

Other than only accept cash currency from your friend, another suggestion that crossed my mind is to maybe ask your friend to write two (2) $200 checks or four (4) $100 checks so you can at least offset some of the rent due temporarily every so many weeks...

you can cash it without a problem, but as soon as that check tries to clear his account it'll come back to you r account, and debit the money, since it was cashed, its the banks way of getting thier money back

If the check is made out to you - and you KNOW it's a bad check... you can cash it.

This happened to my boyfriend before. Someone wrote him a bad check and his account got hit with fees and of course the money did not get deposited into his account but the other person would be the one responsible for the amount of the check plus any fees incurred from writing the bad check. He wasn't responsible for the actual amount of the check. Of course he didn't cash it he just deposited it, if you do cash it you will definitely be responsible for putting the amount back into your account since it was taken out and then not paid back with the bad check.

They'll go after both of you. Him for writing the check, and you for cashing it. If your lucky, you could claim that you didn't know it was bad and they might go easy on you, but most of the time....the bank doesn't care. They'll charge you all of the fees for cashing a bad check....and if they're really bad...they could file a police report on you.
