Am i going to jail for fraud?
I got myself into quite a mess with payday loans a while back. Most of the places I have been able to set up payment plans, but one place said they could only take the money out of my bank account (which is frozen) anyway some guy from this place called and said I have till noon today to come up with $935 or it is going to be reported with fraud and Im going to jail. I dont know what to do. I'm 9 weeks pregnant and im not handling this well...juts kind of freaking out right now. I;m waiting for an attorney to contact me but I'm scared of what he will say. Just wondering if anyone knew anything about these things.

Heather...they CANNOT send you to jail. CANNOT!!! This is considered a loan and there are not debtors prisons. These companies use this scare tactic to try to intimidate people into paying. Your loan was backed by a check and you probably did it on the internet so they make up all of these charges and state they are going to prosecute. DO NOT be intimidated and let them know that you will pay them when you can. You are not going to have the police at your door. I worked for a Pay Day Loan company (shame to admit) so I have heard them do all of these things. It is actually against the law and you may want to threaten to contact the Federal Trade Commission for illegal collection practices if this individual continues And Please don't give them a checking account or debit card number for future payments...pay them by money order because they will drain your account !!! Please relax and take care of your unborn baby. Believe me these people cannot press charges ok??? take care and good luck

Settle down and wait until your attorney calls you ,even if you have to file reorganization don't allow anyone to intimidate you ,remember your not the only one that owes people and the attorney can also help get your bank account back, for as fraud if I understand right you just owe this loan an that is not fraud unless there is more to this than you have stated but if everyone was accused of fraud because they owe someone then we would all be in jail !No doubt you might owe this but for someone to actually make you feel like your going to jail is so wrong an I would keep a record of everything they have said an let my attorney know . I pray for you !! but for yours an the baby sake settle down an enjoy the moment for no one is sure about tomorrow .!!

i can't say for sure that your going to jail, thats something for the courts to decide. but i would talk to a real attorney and try to work things out with the creditor, out of court to avoide even more court costs.

I have been there with those payday load places. They are bad news. I was getting loans from one place just to pay off another place. Then I was broke so I had to re borrow from the place I just paid off. When i got behind, yeah they called, but they didn't go to those extreams. Don't worry. They will call, they'll send letters just make sure you make payments, anything to show you are trying. and never go to those places again. They are like soft-core scams.

You have been irresponsible with money, but you've done the right thing by contacting all the companies and making your position clear to them. It was wrong of the guy who called to threaten you in that manner.

Take a deep breath and make yourself a cup of tea. Then sit down with the yellow pages and call another attorney as well for advice.

It may seem like a dreadful day, but you will get through this. Just stay calm and write everything that is said to you down, you are not going to be able to take it all in.

Those guys get PAID to scare the hell out of you so that you will pay up. Don't be intimidated. Consult your lawyer and follow his or her advice. In the meantime, screen your calls with Caller ID or your answering machine.

It would cost them more to put you in jail (attorney fees, court cost, filing fees) then to write it off. Don't worry. Just make minimal payments and you'll be fine. As everyone else says... they are just using scare tactics!

they survive on the scare factor......just sit back and relax...they will want to garnish your wages I am sure but I think that comes first then to just throw you in jail....hope this teaches you something though!

I don't know much about that particullar situation but I can tell you this, I got myself into a situation with a doctor bill that wasnt my responsibility to pay because I was only 15 at the time, the collection agency talked me into sighning a promissary note when I was 18 because they were supposedly going to take my grandma to court (she wasnt responsible for it either, she just gave the hospital permission to treat me bacause they couldnt get in touch with either of my parents) Anyway, so I promised to pay them $150.00 a month, I paid a total of $1200.00 and lost my job & could'nt pay them as much, I offered to pay them $10.00 a month and they refused, So I called a lawyer and he spoke with them. The conclusion was that as long as I was offering to pay (no matter what amount) they couldn't legally do anything! It wound up that I didn't have to pay anything else either!! My lawyer convinced them that I wasnt responsible and they agreed because they knew the judge would feel the same way. So my advice to you is to offer to pay them something, If they decline and you have to go to court, the judge will see that atleast you tried and will probably throw it out if you agree to pay them so much per month!!!

Stay calm, heather. I don't think it's a fraud case for not able to pay for loan. Talk to your attorney. Find out why they don't accept other method of payment. Find out whether that's the truth or maybe that guy is lying. You're pregnant, so don't scare the hell outta yourself with things like this.

I think the guy is full of crap! Those places will take a payment in a heart beat, checking account or not? I mean, who wouldn't take a cash payment?! Just calm down, its not good for you or the baby to start worrying over a jerk. The lawyer will be able to set up a payment plan for you. Just learn from this and you won't have to go through it again. Good luck to you and Congrats on the baby!

They use scare tactics to get paid. You aren't going to jail, the isn't a debtor's prison anymore. It isn't fraud its default on a loan. As far as the payment from a bank account tell them that if they want to get paid they will have to accept payment via check otherwise you will not pay. I had them try that with me and eventually they stopped calling me and never got paid. Don't be scared they want you to feel guilty into paying them back. Try sending them money even if its one dollar if they cash the check its proof that you are willing to pay them back. You can use it in court as evidence that you are willing and they are unreasonable.

They want their money,you can't pay them if your in jail.If you actually get to the point where you end up in court you'll be ordered to make restitution.Listen to your attorney and set up a payment plan and don't do it again.You'll be fine.
