Bank mistake...keep extra cash?
I cashed a check for ~ 30.00 and the bank made a mistake and paid me 300.00!!! I didn't say anything and now their calling me! I know keeping it is wrong but I really need the money! Unfortunately...I have a savings account at that bank and will have to deal with them in the futur. DO I LEGALLY HAVE TO RETURN THE MONEY IF THEY ASK?

Yes legally you must return the money asap. Otherwise bank will call police, have you arrested and you will be spending thousands in lawyer fees.

Would you really keep the money. Banks make mistakes just like the rest of us and you should have return it as soon as you saw that they made a mistake. I could not sleep at night knowing what I had done.

Obviously the bank must have proof of what happened, otherwise they would not know to call you. So yes, you must return the money or it's considered theft.

It is called theft, because you knowingly took the extra money. So you could be prosecuted....It is like going in a grocery store and stealing a candy bar...you knowingly took it. A bank just happens to deal with money...not candy bars.....Just try to make the situation right, I guess....you will probaly feel a bit uncomfortable....but oh well...that's just going to be a consequence after the fact...

You honestly needed to ask this on Yahoo Answers??!?!??! What do you think we'd say? It's theft if you don't return the cash.

To Studly...the banker in your example isn't intentionally trying to put your money into someone else's account. Once the error is realized, they would have corrected it. The asker knows they made a mistake giving her extra money; she still can't keep it. Let's use some common sense.

She may not be prosecuted or charged with theft legally; but let's skip the pretense and call it what it is.

Yes, you do! It is morally wrong and your conscience won't allow you to do it. Things like this have a way of coming back and haunting you. On the other hand, when you turn it in, it will come back to you 10 fold. Get on the phone now and call the police and tell them exactly what happened. The longer you wait, the worse it looks. Believe me, you are doing the right thing by turning in the money.

The teller made a pretty bad mistake. But you certainly knew the difference between that $30 check and the $300 the teller counted out. It says a lot about your character that you took the money and are figuring out how you can keep it.

The bank will deduct it from your account.

Do the right thing. Return the money.

yes it is the banks mistake but it is not your money if they do not hear from you the bank can legally debit your account those funds and then any thing in that account that bounces you are responsible for including the fees. Just think of the account that it needed to go in they are probably having things bounce with out those funds so put your self in there shoes.

To all you folks answering that this person could be arrested for theft for not returning the money.....could you please point me to the law that claims this? Anywhere?

If I gave the bank teller $300 and she only deposited $30, could I have that bank teller arrested for theft? If not, please explain why in light if your previous comment.

In other words, you simply don't know what you are talking about.

At best this is a civil matter between the bank and the customer. At worst, there is a bank teller close to losing their job.

Once upon a time I deposited a few thousand dollars in cash and check, but the teller put them into the wrong bank account. After I complained about where my money went to, they easily saw the error.

That other customer had already taken out the money and spent it! Did they arrest her? No.....there is no law preventing her from doing it.

What they did was write her a "loan" at a very low interest rate in order to repay the loan. Their alternative was to sue for the return of the money...but theft? Get real!

The bank teller came very close to losing her job though.

You can hire a very good lawyer and go to court with them. Get your name on all newspapers and TV channels. Charge $5000 for each interview you get.

Then settle the case, pay back $300 to the bank and pay $10K lawyer fee.
