crazy gal | Bankruptcy in the UK? |
If you go bankrupt and all your debts (like £50K in loans and credit cards) are written off and your home is taken from you, what ELSE can they take? The person I am asking for has a car worth about £1200, after selling their other car to raise the money for the bankruptcy. Can they take things like 2 year old laptops which cost £300 each at the time, or games consoles, tv (2 years old and worth about £400) and collectibles that one has had for years, like sci fi collectibles?
This pal of mine has worked hard for 30 years and had earned every penny that he has bought his possessions with, and has now hit hard times and lost his well paid job, and a few bad investments left him way in debt, and he is going under, so it seems so unfair that he loses his personal possessions too, which he worked hard for. He is losing his home if he goes bankrupt, and he is also losing his financial security. Any help anyone? Additional Details Mohole, you have no idea how this 50K debt came about, so please do not make comments about things that you know NOTHING about. Saying that he deserves to lose everything indeed! He is ALREADY losing his bloody home - that he has worked THIRTY YEARS for: aren't you happy with that?
This pal of ours has worked hard for 30 years and the recession has resulted in his bad debts; NOT over spending on stuff. He has less than half the people around this area who have been on the dole for 20 or 30 years!
At least he has got off his backside and worked for 30 years and hasn't scrounged off the dole or faked an illness to claim incapacity for the last 15 years or had loads of kids by different men, to stay on benefits.
I hope nothing like this ever happens to YOU, although frankly, with your attitude, it would serve you right if it did. Shame on you for your horrible answer. You have no empathy or compassion and sound like a very cruel person. |

Yes, he can lose his personal possessions and why not. As well as 'earning every penny he's bought things with' he's evidently spent money he didn't have. Bad investments do not cause debts unless you buy them with money you don't have. That is the equivalent of gambling. So why should someone else lose out. Of course, if he'd been a bank, the British Government would have bailed him out. |

Personal property is liable for seizure to pay debts.
He can make the case that the laptops and the car are needed to work (or look for work) and maybe the game console and TV (but that;s doubtful)
Stuff like the collectibles he would be better off selling them himself and passing the money to the liquidator - only because the people that seize them have little idea of their true value and will dispose of them at auction for pennies of their true value. |
