me | Bankruptcy question,,, please help? |
I have gotton myself into a financial bind and i feel like I am drowning. I have decided to claim bankruptcy so that I can start over and have piece of mind. I was wondering if anyone knew a good bankruptcy lawyer in arizona? I would like one that is as cheap as possible. Thank you so much. |

You do not want to go with the cheapest lawyer necessarily, you want to go with one that knows what they are doing and practices bankruptcy on a regular basis. With the change in the laws in 2005 it is important to make sure your bankruptcy attorney understands the changes. They may not be the cheapest, but it will still be cheaper than paying off all your debt. Even just looking at the typical responses in regards to bankruptcy on here, it is evident that most people have no clue about bankruptcy. No trustee will try to get you to file a chapter 11.
It is up to them to object to discharge or move to dismiss if you don't meet the means test or have too much assets, but they cannot force you into a Chapter 13 payment plan. Many people do not succeed with chapter 13 because they just can't afford the payments. An attorney cannot guarantee results in a chapter 13 as they have no control over whether the debtor makes the payments unles it comes straight from the debtor's paycheck. |

I wouldn't suggest finding just the cheapest one. Do some research. |

well i file for bankruptcy and if you dont have any money you need a legal aid they would do your bankruptcy for free so google free legal aid assistantance in arizona and give them a call i file bankruptcy because i was drowning in debt like 40,000 now i cant get nothing no car no nothing the only good thing about it is that the creditor cant call and harrass up and you aint gotta worry about them bills but it will take a long time i mean a long time to get your credit back its been two years for mean and my score use to be 675 now its 350 which is terrible the only thing i could get is credit cards and you have to pay a fee for them |

Check the yellow pages and call for estimates. They'll usually let you make payments up until it is final. You'll have to list your debtors, their addresses and what you owe each one. |

You want a GOOD attorney. If you have any assets....car, wedding ring, anything of value, it can be taken away. The trustees job is to be as ruthless as possible and make sure you walk away with NOTHING. Filing Chapter 7 should cost about $1,500. I wouldn't use one of these that advertise on TV. You can find out what the exemptions are for your state online. |

Your first mistake is assuming that a bankruptcy actually starts you with a clean slate, it will alleviate the current debt that you owe but you are left with a black mark on your credit report that doesn't disappear for over 7 years. As for your situation in seeking a lawyer it is really best to do some research for yourself, not every bankruptcy is the same and there could be items that cannot be cleared with your bankruptcy. Pull out the old phone book and explain to the lawyers your situation this way you can get a realistic grasp on how much it will cost for your particular filing. |

Let your fingers do the walking in the Yellow Pages. There are several who specialize in garden variety consumer bankruptcies. |

I just got this on Google http://www.arizonadebtrelief.com/
I hope you get it sorted. Money problems are a nightmare, I feel for you. Breathe deeply and try to have faith it will all work out. Try not to panic, that will just make things worse. Try to sit down and get everything written on paper if you haven't already. Good luck. |

Honestly bankruptcy isn't always the easiest solution. I don't know your circumstance, but speaking with a financial advisor should be your first step, not assuming that bankruptcy is the only way to go.
Bankruptcy helps with the money, but it doesn't approach the habits that got you into debt in the first place. |

best of luck to you. make sure you file chapter 7 to alleviate yourself of all debt. they (bankruptcy trustee) will try to talk you into chapter 11 because this will give you time to pay it all back. dont do it. also the cheapest attorneys are usually about $1,200-$2,000. some offer payment arrangements but they wont actually file until your final payment is received. |
