i am not sure what country you are in and that will make a diffrences but genraly if you have never aplyed for anything in joint names and i mean anything, saving a/c banking a/c creditcards, loans,car loans, store cards, home loan etc. then you do not have joint credit and yes you should be able to do it with out your partner being involed.but if you have ever had any joint credit or accounts then these need to be payed off and closed and you need to wright to the credit agents to unlink your credit 1st. it you are wanting to bankrupt joint credit then enther you ask the people they are with to transfer them to your own name and again once you ahve done that to all of them wright to the credit people to unlink your scores but if the people you have the debt with will not change it to just your name then you will have to file together. (this is info from england but wether you are in england or somwere elss i adives you speak to a pofetional on what you can do.)

Yes, but then he will be solely liable for all of the debt and most likely he will have to file for bankruptcy too. Best to file jointly if you hold your assets jointly.

Yes, but be aware that your spouse will more than likely find out. Any good bankruptcy attorney can give you the details, and most will talk to you on the phone about it. If they're busy, ask to speak to their paralegal.
