Can I cash a Signed Cashiers Check that I found?
While out riding my bike I found a signed cashiers check for $550. It was signed with a signature that was the same as the payee name on the check. I know that a signed certified check is a bearer instrument and banks are obligated under law to pay out valid withdraw demands. I also always learned that a signed bank check is like finding money. So is this like finding money? If the bank cashes it for me am I in the clear? I don't know if the signature was from the guy it was intended for but then again, is that my responsibility to verify or is it the banks? I'm thinking of signing it and cashing the thing. No, it is not like finding cash. Do not attempt to cash this check as yours. It may get you into more trouble than $550.00 can buy!

First, of all if it were cash, this is not a trivial amount of money to just hang on to. If you found a few bucks, $5 or $10, there is no reasonable expectation that you would ever be able to find the owner, nor would you be expected to. The owner probably wouldn't miss it much either. However, there comes a point where the amount of money reaches a threshold where the owner would reasonably miss it. $550 certainly crosses that threshold and you would be ethically obligated to make some amount of effort to return it. Such as turning it in to the local authorities as lost property. If left unclaimed after what ever statute of time applies in your area, then the cash would be yours to claim.

Finally, since you found a check, made out to a bearer by the account holder with their account information, there is knowledge of who the owner is and an expectation for you to return the check. Even though the check was signed and you found it, it is not the same as cash and it does not make it rightfully yours. It is lost property that should be returned. You could land yourself in trouble if you tried to cash this check. It maybe reported as stolen, in which case you would have a lot of explaining to do. Good luck with that! It may have been reported missing and a stop payment oder placed on it. Then you would still have some explaining to do. In any event, the issuer of the check did not intend for you get the money. You would be in effect, stealing their money. A grainy bank-camera picture of you passing a bad check on the front page of the local paper isn't worth any amount of money.

Just turn the thing in. Honesty is always the best policy. Would I like a free $550.00? Sure, but I also like to sleep at night with clear conscience. You should take it to the bank so they could trace back to the account holder who issued the check originally and return it to its rightful owner.

Cashier or certified checks are NOT bearer instruments. A blank money order would be a bearer instrument. But a check with a payee can only be cashed by the payee. Trying to cash it would be fraud.

Do the right thing and turn the check over to the police so that the rightful owner gets their check.

This check is personal property. It is owned by the person who it is made out to. You have the address of the bank on the check. An honest citizen would return it to the bank with the explanation that you found it and want to return it.

Of course, and honest citizen would have already returned it, and wouldn't have thought to ask the question looking for an excuse to essentially steal the money.

1. I believe you misunderstand the law about the bank's obligation to pay the check.
2. Even if it was CASH you found, you can't legally keep it without a good faith attempt to find the rightful owner. Since you have a NAME, and the bank can identify the person that bought the check, a good faith effort WILL be successful.

That's a felony. The check is not made payable to you therefore the funds are not yours. Hopefully a stop payment has been put on that check.

Return the money to the bank mentioned on the check and don't even for a second think to keep it. Aside from how unethical and immoral it is, this is fraud and can cost you so much including jail time, bad credit and criminal history and so much more.

I would check with the bank--talk to a bank officer, not a teller, or the top person at the bank. They will know what needs to be done.

Here's supposedly a true story I heard. Some metal detectors were at a local beach and they found a Rolex watch. It was worth over $20,000. They turned it into the police and found out if it wasn't claimed after a certain length of time, then it became theirs. And, that's exactly what happened. They got the watch, had a clear conscience and then went out and sold it and bought top of the line metal detecting equipment.
